(c) When the total or partial non-observance of the international norms relating to the right to a fair trial, established in the Universal Declaration of Human Rights and in the relevant international instruments accepted by the States concerned, is of such gravity as to give the deprivation of liberty an arbitrary character (category III);

Therefore, the Working Group believes that in the case of Mr. Zammar, the violation of the international norms related to a fair trial is of such gravity as to confer on the deprivation of his liberty an arbitrary character.

14. The Working Group believes that a violation of the individual's right to a fair hearing has occurred, and that this violation is of such gravity as to confer on the deprivation of liberty an arbitrary character.

This absence of guarantees therefore constitutes a violation of the right to a fair trial of such gravity that it confers on the deprivation of liberty an arbitrary character.

52. The Working Group considers that infringements of these rules of due process of law constitute violations that do give to Mr. Cedeño's deprivation of liberty an arbitrary character because:

This constitutes a violation of articles 9 and 10 of the Universal Declaration of Human Rights and of principles 10, 11, 12, 13, 15, 16, 17, 18, 19 and 33 of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment which is of such gravity as to confer on the deprivation of liberty an arbitrary character.
