The organ of inquiry may, before bringing charges, detain a person suspected of having committed an offence punishable by deprivation of liberty only where one of the following grounds exists:

Under this principle, everyone has the right to personal liberty and may be deprived of liberty only for the reasons and following the procedure provided for by law.

وينبغي إيلاء اهتمام خاص للنظر في الحرمان من الحرية فقط بوصفه إجراء يتخذ كملاذ أخير وﻷقصر مدة زمنية ممكنة ولحماية حقوق اﻷطفال المحرومين من حريتهم ولتطبيق القوانين على النحو الواجب وتحقيق استقلال الجهاز القضائي استقلالا تاما ونزاهته.

In general, juveniles were deprived of their liberty only as a measure of last resort.

143. The Rapporteur recommended that children should be deprived of liberty only as a last resort.
143- وكان المقرر الخاص قد أوصى بأنه لا ينبغي حرمان الأطفال من الحرية إلا كملاذ أخير.

ولا بد من الاهتمام بوجه خاص بعدم اللجوء الى الحرمان من الحرية إلا كحل أخير وﻷقصر فترة زمنية ممكنة، وبحماية حقوق اﻷطفال المحرومين من حريتهم في المحاكمة العادلة، واستقلال ونزاهة القضاء.

132. The Committee strongly urges the State party to use the deprivation of liberty only as a measure of “last resort” in dispensing juvenile justice, as required by the Convention.

(ب) ألا تستخدم الحرمان من الحرية إلا كملاذ أخير ولأقصر فترة ممكنة؛ وأن تحمي حقوق الأطفال المحرومين من حريتهم بما في ذلك حقهم في حرمة حياتهم الشخصية وضمان بقائهم على اتصال مع أسرهم؛

(b) Consider deprivation of liberty only as a measure of last resort and for the shortest possible time, limit by law the length of pre-trial detention and ensure that the lawfulness of this detention is reviewed by the judge without delay and then regularly;

(ج) اتخاذ جميع التدابير اللازمة لضمان ألا يُحرم الأشخاص دون سن 18 عاماً من حريتهم إلاّ كإجراء أخير ولأقصر فترة ممكنة، وخاصة من خلال وضع وتنفيذ بدائل عن عقوبة الحرمان من الحرية، بما في ذلك إنشاء مراكز بدائل الإجراءات القضائية و/أو عيادات قانونية للأطفال المخالفين للقانون؛
