أما فيما يتعلق بالتصديق على الاتفاقيات الخمس الباقية فإن الجماهيرية العربية الليبية قد صدقت على الاتفاقيات التالية:

Unfortunately, the current upheaval in the Libyan Arab Jamahiriya has resulted in large numbers of migrants from the Sahel returning to their countries of origin.
ومما يؤسف له أن الاضطراب الحالي في الجماهيرية العربية الليبية قد أسفر عن عودة أعداد كبيرة من المهاجرين من منطقة الساحل إلى بلدانهم الأصلية.

With regard to that latter question, Burkina Faso believes that the Libyan Arab Jamahiriya has fully discharged its obligations to the Security Council and that the sanctions imposed on it should now be lifted.
وفيما يتعلق بتلك المسألة الأخيرة، تعتقد بوركينا فاسو أن الجماهيرية العربية الليبية قد أوفت وفاء كاملا بتعهداتها لمجلس الأمن وأن الجزاءات المفروضة عليها ينبغي أن تُرفع.

At the same time, the Libyan Arab Jamahiriya has publicly stated on several occasions that it will comply with the conclusions of the Scottish court, whatever they may be, and if required will pay the necessary compensation.
وفي الوقت نفسه، فقد أعلنت الجماهيرية العربية الليبية على المﻷ في مناسبات عديدة أنها ستمتثل لقرارات المحكمة الاسكتلندية مهما كانت، وأنها ستدفع التعويضات اللازمة إذ ما اقتضى اﻷمر ذلك.

For the purpose of this report, I shall recall some of the statements by which the Libyan Arab Jamahiriya has conveyed its position to the Security Council.
ولتحقيق أهداف هذا التقرير، فسأذكر ببعض البيانات التي نقلت الجماهيرية العربية الليبية من خلالها موقفها إلى مجلس اﻷمن.

The Libyan Arab Jamahiriya has mobilized the requisite funding for the promotion of cultural development and popular participation in cultural life, including support and promotion of private initiatives. The 2002 development budget allocated funds for that purpose, as the following table shows:
122- حرصت الجماهيرية العربية الليبية على توفير الموارد المالية اللازمة لتشجيع الإنماء الثقافي والمشاركة الشعبية في الحياة الثقافية وتشجيع ودعم المبادرات الخاصة واشتملت ميزانية التحول التنموي لعام 2002 مخصصات مالية على النحو المبين بالجدول التالي:

(d) That the beginning of the trial must be the end of this dispute, for the Libyan Arab Jamahiriya has already responded to all the demands of the Security Council. The sanctions should be lifted upon the appearance of the two suspects before the trial.
)د( أن يكون بدء هذه المحاكمة هو نهاية هذا النزاع، حيث أن الجماهيرية العربية الليبية قد استجابت فعلا إلى جميع مطالب مجلس اﻷمن، لذا ينبغي رفع العقوبات بمجرد مثول المتهمين أمام المحكمة.

1. To note that the Libyan Arab Jamahiriya has reported annual data for the controlled substances in Annex A, group II (halons), for 2003 which is above its requirements for those substances.
1 - أن يشير إلى أن الجماهيرية العربية الليبية قد أبلغت البيانات السنوية عن المواد الخاضعة للرقابة في المرفق ألف المجموعة الثانية (الهالونات) لعام 2003، وهي تزيد عن احتياجاتها من هذه المواد.

22. As the requirements referred to in document A/46/825-S/23306 have been met, it may be concluded that the Libyan Arab Jamahiriya has thus complied in this regard with the relevant requirements of Security Council resolutions 731 (1992) and 748 (1992).
٢٢ - ولما كانت الشروط المبينة في الوثيقة A/46/825-S/23306 قـد استوفيت، فـإن ذلـك قـد يعنـي أن الجماهيرية العربية الليبية قد امتثلت في هذا الصدد للشروط الناشئة عن قراري مجلس اﻷمن ٧٣١ )١٩٩٢( و ٧٤٨ )١٩٩٢(.

Further to my letters dated 17 and 30 January 2002 (A/56/780 and Add.1), I have the honour to inform you that the Libyan Arab Jamahiriya has made the necessary payment to reduce its arrears below the amount specified in Article 19 of the Charter of the United Nations.
إلحاقا برسالتي المؤرختين 17 و 30 كانون الثاني/يناير 2002 A/56/780) و (Add.1، يشرفني إبلاغكم بأن الجماهيرية العربية الليبية قد قامت بتسديد المبالغ اللازمة لخفض متأخراتها إلى ما يقل عن المبلغ المحدد في المادة 19 من ميثاق الأمم المتحدة.

7. The Libyan Arab Jamahiriya has prepared a draft criminal code which aims at revising corporal punishments (the death penalty) and the penalty of deprivation of liberty. In this code, the scope of the death penalty is reduced and is confined to persons whose life poses a threat to others.
7- إن الجماهيرية العربية الليبية قد أعدت مشروع قانون العقوبات الذي يهدف إلى إعادة النظر في العقوبات الجسدية (الإعدام) والمقيدة للحرية، بحيث تم تضييق نطاق تطبيق عقوبة الإعدام، وجعلها مقصورة على من تشكل حياته خطراً على الآخرين.

16. In light of the information received, and given that the Government has not provided any reasons to doubt the above allegations, the Working Group is of the opinion that the Libyan Arab Jamahiriya has violated articles 1, 2, 3, 5, 6, 7, 8, 9, 10 and 11 of the Universal Declaration of Human Rights as well as articles 2, 3, 7, 9, 10, 12 and 14 of the International Covenant on Civil and Political Rights.
16- وفي ضوء المعلومات التي وردت إلى الفريق العامل وبالنظر إلى أن الحكومة لم تقدم أي أسباب للشك في الادعاءات المذكورة أعلاه، فإنه يرى أن الجماهيرية العربية الليبية قد انتهكت المواد 1 و2 و3 و5 و6 و7 و8 و9 و10 و11 من الإعلان العالمي لحقوق الإنسان وكذلك المواد 2 و3 و7 و9 و10 و12 و14 من العهد الدولي الخاص بالحقوق المدنية والسياسية.

We assert once again our complete satisfaction that the Libyan Arab Jamahiriya has complied fully with the demands of the Security Council contained in its resolutions 731 (1992), 748 (1992), 883 (1993) and 1192 (1998).
وقد اجتمعنا في مدينة نيويورك بتاريخ 17/9/2002 بحضور ممثلين عن كل من منظمة المؤتمر الإسلامي، وتجمع دول الساحل والصحراء حيث تدارسنا آخر تطورات هذا الموضوع، نؤكد من جديد اقتناعنا الكامل بأن الجماهيرية العربية الليبية قد التـزمت بالكامل بتنفيذ مطالــب مجلس الأمـــن الـواردة في القرارات رقم 731 (1992)، و 748 (1992)، و 883 (1993)، و 1192 (1998).

2. Convinced of the importance of cooperating with the United Nations in the maintenance of international peace and security, the Libyan Arab Jamahiriya has declared in numerous letters addressed to you its total renunciation of terrorism in all its forms and its condemnation of all acts of terrorism.
٢ - اقتناعا بأهمية التعاون مع اﻷمم المتحدة في مجال حفظ السلم واﻷمن الدوليين، أعلنت الجماهيرية العربية الليبية في عدة رسائل وجهت الى سيادتكم نبذها الكامل لﻹرهاب بشتى صوره، وإدانتها لكافة اﻷعمال اﻹرهابية، وعبرت عن هذا الموقف الواضح بعدة إجراءات محددة، منها على سبيل المثال لا الحصر:

We also hope the embargo imposed on the Libyan people will be lifted. We are aware that the Libyan Arab Jamahiriya has shown tangible proof of its readiness to cooperate with the United Nations and other groups and that the embargo is affecting the interests of all other peoples in the Maghreb.
كما أننا نأمل، من جهة أخرى، أن يتم رفع الحصار المضروب على الشعب الليبي، نظرا لما أبدته الجماهيرية العربية الليبية من استعداد للتعاون مع اﻷمم المتحدة واﻷطراف المعنية اﻷخرى ونظرا لكون هذا الحصار قد أضر بمصالح كافة الشعوب المغاربية اﻷخرى.

For all these reasons, the Libyan Arab Jamahiriya has been anxious to strive by all available means to end this dispute in a manner that is in keeping with the norms and provisions of international law and in compliance with the letter and spirit of the resolutions adopted by the United Nations. The Libyan Arab Jamahiriya has left no stone unturned to find a way out of this problem, as has been demonstrated in my numerous communications with you.
ولهذه اﻷسباب مجتمعة، حرصت الجماهيرية العربية الليبية على أن تعمل بكل الوسائل المتاحة على إنهاء هذا النزاع بما يتفق مع قواعد الشرعية وأحكام القانون الدولي، وبما يستجيب لمنطوق وروح القرارات الصادرة عن اﻷمم المتحدة، ولم تترك الجماهيرية العربية الليبية بابا يؤدي الى مخرج من هذه المشكلة إلا طرقته حسبما هو ثابت من مراسلاتي المتعددة معكم.
