14. The rule contained in article 51 paragraph 5 a) is of particular importance as regards the use of cluster munitions, as it prohibits " an attack by bombardment by any methods or means which treats as a single military objective a number of clearly separated and distinct military objects located in a city, town, village or other area containing a similar concentration of civilians or civilian objects " .

41. One response stated that the rule against indiscriminate attacks is of particular importance with regard to the use of cluster munitions because it prohibits `an attack by bombardment by any methods or means which treats as a single military object a number of clearly separated and distinct military objectives located in a city, town, village or other area containing a similar concentration of civilians or civilian objects' .
41- وقد ورد في أحد الردود أن القاعدة التي تحظر الهجمات العشوائية تتسم بأهمية خاصة فيما يتعلق باستعمال الذخائر العنقودية، وذلك لأنها تحظر `الهجوم قصفاً بالقنابل، أياً كانت الطرق والوسائل، الذي يعالج عدداً من الأهداف العسكرية الواضحة التباعد والتميز بعضها عن البعض الآخر والواقعة في مدينة أو بلدة أو قرية أو منطقة أخرى تشهد تركزاً من المدنيين أو الأعيان المدنية`().

According to article 51 of the first Additional Protocol to the Geneva Conventions of 1949, an indiscriminate attack is: “An attack by bombardment by any methods or means which treats as a single military objective a number of clearly separated and distinct military objectives located in a city, town, village or other area containing a similar concentration of civilians or civilian objects.”
وتحدد المادة ٥١ )٥( أ من البروتوكول اﻹضافي اﻷول ماهية الهجوم العشوائي على أنه: " الهجوم قصفا بالقنابل، أيا كانت الطرق والوسائل، الذي يعالج عددا من اﻷهداف العسكرية الواضحة التباعد والتميز بعضها عن البعض اﻵخر والواقعة في مدينة أو بلدة أو قرية أو منطقة أخرى تضم تجمعا من المدنيين أو اﻷهداف المدنية، على أنها هدف عسكري واحد " .
