2.2 On 27 May 2008, the justice of the peace of the 33rd district of Velikie Luki issued a decision to terminate the court case against the author based on the absence of corpus delicti of the crime.

2.5 On 15 October 2009, the author filed an application with the town court of Velikie Luki seeking compensation for the moral damages inflicted to him by the public being wrongly informed that he was under investigation for criminal activity.
2-5 وفي 15 تشرين الأول/أكتوبر 2009، قدم صاحب البلاغ طلباً إلى محكمة مدينة فيليكي لوكي لتعويضه عن الأضرار المعنوية التي لحقت به بسبب تقديم معلومات خاطئة إلى الجمهور عن خضوعه للتحقيق بسبب نشاط إجرامي.

The author maintains that the provision of the domestic legislation cited above allows him to file a claim in the court of his place of residence, that, being a pensioner, he has no means to defend his rights in Moscow courts and that the refusal of the Velikie Luki town court to hear his case constitutes a denial of justice.
ويؤكد صاحب البلاغ أن الحكم المذكور من التشريع المحلي يسمح له برفع دعواه في محل إقامته، ولكونه متقاعداً فلا سبيل له للدفاع عن حقوقه في محاكم موسكو، ورفض محكمة مدينة فيليكي لوكي النظر في قضيته يشكل رفضاً لإقامة العدالة.

The author's complaint was returned to him by the town court of Velikie Luki with a note dated 23 October 2009, that the court lacked jurisdiction over the case, based on article 135, paragraph 1, point 2, of the Criminal Procedure Code.
ورفضت محكمة مدينة فيليكي لوكي دعواه وأفادت في مذكرة مؤرخة 23 تشرين الأول/أكتوبر 2009 بأنها غير مختصة بالنظر في القضية استناداً إلى البند 2 من الفقرة 1 من المادة 135 من قانون الإجراءات المدنية.

5.2 The author further rejected the submission by the State party that the requirement for review of his complaint by the Moscow court, and not by the court in Velikie Luki, did not constitute a limitation of his access to justice.
5-2 ورفض صاحب البلاغ أيضاً ما ذكرته الدولة الطرف من أن شرط قيام محكمة موسكو وليس محكمة فيليكي لوكي بالنظر في شكواه لا يشكل قيداً على إمكانية وصوله إلى العدالة.

6.3 The author submitted that, during the prosecution proceedings against him, he was forcibly placed in a psychiatric hospital for 30 days following the decision of a judge of the Velikie Luki town court dated 2 August 2006.
6-3 وأفاد صاحب البلاغ بأنه خلال إجراءات محاكمته أودع قسراً في مستشفى للأمراض النفسية لمدة 30 يوماً بناء على قرار أحد القضاة في محكمة مدينة فيليكي لوكي بتاريخ 2 أب/أغسطس 2006.

On 15 March 2010, the author had addressed a petition to the justice of the peace in the 33rd district of Velikie Luki requesting the latter to recognize that the author's rights under article 17 of the Covenant had been violated.
