(18) The Committee expresses its concern at the fact that the State party does not have uniform legislation ensuring that any statement which is established to have been made as a result of torture shall not be invoked as evidence in any proceedings, as required by article 15 of the Convention.

47. According to article 15 of the Convention, only those statements are inadmissible as evidence which are " established to have been made as a result of torture " .
47 - ووفقا للمادة 15 من الاتفاقية، لا يكون من الأقوال غير مقبول كأدلة إلا تلك التي " يثبت أنه تم الإدلاء بها نتيجة للتعذيب " .

The Committee observes that, under article 15 of the Convention, the State party has accepted the obligation of ensuring that any statement that is established to have been made as a result of torture shall not be invoked as evidence in any proceedings, and therefore the submission by the complainant relates to the merits of his allegations under article 15 of the Convention.
وتلاحظ اللجنة أن الدولة الطرف قد قبلت بموجب المادة 15 من الاتفاقية، الالتزام بضمان عدم الاستشهاد بأية أقوال يثبت أنه تم الإدلاء بها نتيجة للتعذيب كدليل في أية إجراءات، وعليه فإن بلاغ صاحب الشكوى له صلة بالأسس الموضوعية للادعاءات التي تستند إلى المادة 15 من الاتفاقية.

This follows from the wording of article 15 which obliges the State party to " ensure that any statement which is established to have been made as a result of torture shall not be invoked as evidence in any proceedings " .

6.11 At the same time, the Committee notes that, for the prohibition in article 15 to apply, it is required that the statement invoked as evidence be " established to have been made as a result of torture " .
6-11 وفي الوقت ذاته، تلاحظ اللجنة أنه كي ينطبق الحظر المنصوص عليه في المادة 15 يقتضي أن تكون الأقوال المستشهد بها كدليل " قد ثبت أنه تم الإدلاء بها نتيجة للتعذيب " .

25. The SPT also recommends that all necessary steps be taken to ensure that any statement which is established to have been made as a result of torture shall not be invoked as evidence in any proceedings, except against a person accused of torture as evidence that the statement was made.
25- وتوصي اللجنة الفرعية أيضاً باتخاذ جميع الخطوات الضرورية لكفالة عدم الاستشهاد بأية أقوال يثبت أنه تم الإدلاء بها نتيجة للتعذيب كدليل في أية إجراءات قضائية، إلا إذا كانت تلك الأقوال ضد شخص متهم بارتكاب أعمال تعذيب.

Moreover, the Committee found that the complainant's extradition to Spain was not in breach of article 15 of the Convention, since it had not been established that the statement of an ETA convict made before the Spanish police, on which the Spanish extradition request to the State party was allegedly based, had been made as a result of torture. 44. With regard to article 15 of the Convention ( " Each State Party shall ensure that any statement which is established to have been made as a result of torture shall not be invoked as evidence in any proceedings " ), under the provisions of the Islamic sharia such statements are inadmissible as evidence since anyone who confesses to an offence must do so of his own free will and no confession made under torture can be held against him.
44- وفيما يتعلق بما تضمنته المادة 15 من الاتفاقية من " ضمان كل دولة طرف عدم الاستشهاد بأية أقوال يثبت أنه تم الإدلاء بها نتيجة للتعذيب ... " ، تضمنت أحكام الشريعة الإسلامية عدم الاعتداد بمثل ذلك واشترطت أن يكون المعترف بأي ذنب مختاراً فلا يؤاخذ شخص باعتراف أخذ تحت التعذيب.

Article 15 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment provided that " any statement which is established to have been made as a result of torture shall not be invoked as evidence in any proceedings " .
4- وتنص المادة 15 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة على " عدم الاستشهاد بأية أقوال يثبت أنه تم الإدلاء بها نتيجة للتعذيب كدليل في أية إجراءات " .
