Where a contracting state makes extradition conditional on the existence of a treaty receives a request for extradition from another contracting state with which no extradition treaty exists the requested state may consider this convention as the basis for extradition in respect to the listed offences.

Pursuant to paragraph 2, if a Contracting State which makes extradition conditional on the existence of a treaty receives a request for extradition from another Contracting State with which it has no extradition treaty, it may at its option consider the Convention as the legal basis for extradition in respect of the offence, subject to the other conditions provided by its law.

Article 16, paragraph 4, for example, provides that, where a State party makes extradition conditional on the existence of a treaty, the Convention itself may be considered a legal basis for extradition in respect of an extradition request concerning an offence covered by the Convention received from another State party with which the requested State has no extradition treaty.
