The Bar Council of Malaysia (BCM) indicated that Malaysian courts have taken the clear position that the Universal Declaration of Human Rights (UDHR) is not legally-binding, and the Government of Malaysia (GOM) has stated on numerous occasions that the UDHR would only be given effect insofar as it is not inconsistent with the Federal Constitution (FC).

196. The Special Rapporteur also drew the attention of the Commission to the ongoing four defamation suits against him before the Malaysian courts (ibid., paras. 115-120 and E/CN.4/1988/39/Add.5).
