9. From 26 December 2009 until 2 January 2010, Messrs. Mustafa, Saleh and Malla Ahmad were detained in a solitary confinement.

10. According to the information received, for more than five months, Messrs. Mustafa, Saleh and Malla Ahmad were held in secret detention, deprived of any contact with the outside world and with their families.
10- وتفيد المعلومات المتلقاة بأن السادة مصطفى وصالح وملا أحمد سُجنوا في مكان سري لمدة تتجاوز خمسة أشهر وحُرموا من أي اتصال بالعالم الخارجي وبأُسرهم.

At this occasion, they were informed that Messrs. Mustafa, Saleh and Malla Ahmad were charged with an " attempt at secession " under article 267 of the Syrian Criminal Code.

12. The source informs the Working Group that, between 29 December 2009 and 6 June 2010, Messrs. Mustafa, Saleh and Malla Ahmad were kept in secret detention, without any legal basis and any possibility of contact with the outside world.

Reportedly, the only reason for the summoning of Messrs. Mustafa, Saleh and Malla Ahmad by the security services relates to a conference held on 3 December 2009 with a view to peacefully debating the situation of the Kurdish minority in the Syrian Arab Republic.
وتفيد التقارير بأن السبب الوحيد وراء استدعاء الجهاز الأمني السادة مصطفى وصالح وملا أحمد يتعلق بمؤتمر عُقد في 3 كانون الأول/ديسمبر 2009 بغية إجراء مناقشة سلمية بشأن وضع الأقلية الكردية في الجمهورية العربية السورية.

22. In respect of the procedure followed, the Working Group notes that Messrs. Mustafa, Saleh and Malla Ahmad were arrested on 26 December 2009 and taken to an undisclosed location in breach of article 9 of the Universal Declaration of Human Rights and article 9 of the International Covenant on Civil and Political Rights.
22- وفيما يتعلق بالإجراء المتبع، يلاحظ الفريق العامل أن السادة مصطفى وصالح وملا أحمد اعتُقلوا في 26 كانون الأول/ديسمبر 2009 واقتيدوا إلى مكان مجهول مما يشكل انتهاكاً للمادة 9 من الإعلان العالمي لحقوق الإنسان والمادة 9 من العهد الدولي الخاص بالحقوق المدنية والسياسية.

It was also the first time that the families of Mr. Mustafa, Mr. Saleh and Mr. Malla Ahmad had access to information about their fate and whereabouts.
وكانت تلك أيضاً هي المرة الأولى التي حصلت فيها أسر السيد مصطفى والسيد صالح والسيد ملا أحمد على معلومات عن مصيرهم ومكان وجودهم.

15. The source alleges that Mr. Mustafa, Mr. Saleh and Mr. Malla Ahmad have been precluded from contesting the legality of their arrest detention.

25. Consequent upon the opinion rendered, the Working Group requests the Government of the Syrian Arab Republic to immediately release Mohamed Ahmed Mustafa, Hassan Ibrahim Saleh and Maarouf Ahmad Malla Ahmad and provide them with adequate reparation.
25- وبناء على هذا الرأي، يطلب الفريق العامل إلى حكومة الجمهورية العربية السورية أن تطلق فوراً سراح محمد أحمد مصفى وحسن إبراهيم صالح ومعروف أحمد ملا أحمد وأن تقدم إليهم تعويضاً كافياً.
