6.5 With regard to the alleged violation of article 14, paragraph 3 (d), the Committee notes that it is clear from the material before it, that the author was present at his trial and that he was afforded legal assistance.

It notes that the material before it does not demonstrate that, by reviewing the author's case, the courts lacked independence.

10.6 As to the author's remaining claims, the Committee considers that the material before it does not enable it to conclude in a definitive manner that the explosion on the newspaper's premises and the resulting death of the author's son can be imputed to the State party's authorities seeking to prevent him from performing his duties as a journalist.
10-6 أما فيما يتعلق بباقي ادعاءات صاحبة البلاغ، فإن اللجنة تَعتبر أن المواد التي بين يديها لا تُمكنها من الخلوص جزماً إلى أن الانفجار الذي حدث في مقر الجريدة أسفر عن مقتل ابن صاحبة البلاغ يمكن نسبته إلى سلطات الدولة الطرف التي سعت إلى منعه من أداء مهامه كصحفي.

7.7 The Committee is accordingly of the view that the material before it suggests that insufficient weight was given to the author's allegations of torture and the real risk he might face if deported to his country of origin, in the light of the documented prevalence of torture in Sri Lanka.
