46. Subparagraphs 1 (a) and 1 (b) establish two conditions for a party to exercise the right to withdraw: to notify the other party as soon as possible and not to have used or received any material benefit or value from the goods or services, if any, received from the other party.
46- تضع الفقرتان الفرعيتان 1(أ) و 1(ب) شرطين لممارسة طرف حق السحب هما: ضرورة إبلاغ الطرف الآخر بالخطأ في أقرب وقت ممكن، وعدم استخدام ما قد يكون الشخص تسلمه من سلع أو خدمات من الطرف الآخر أو عدم حصوله منها على أي منفعة أو قيمة مادية.

It was added that the combined impact of subparagraphs (a) and (c) already resulted in limiting the time within which an electronic communication could be withdrawn, since indeed withdrawal had to occur " as soon as possible " , but in any event not later than the time when the party had used or received any material benefit or value from the goods or services received from the other party.

Ms. Kamenkova (Belarus), pointing out that the word " and " should be inserted at the end of draft subparagraph (a), said that the right to withdraw an electronic communication containing an input error depended, first, on the person or party notifying the other party as soon as possible after learning of the error, and, second, on the person or party not having used or received any material benefit or value from the goods or services received.

The combined impact of subparagraphs 1 (a) and 1 (b) limits the time within which an electronic communication could be withdrawn, since withdrawal has to occur " as soon as possible " , but in any event not later than the time when the party had used or received any material benefit or value from the goods or services received from the other party (A/60/17, para. 103).
