وبناء على ما تقدم، توصي اللجنة بأن يتقاضى عضو محكمة العدل الدولية الذي يعاد انتخابه واحدا من ثلاثمائة من استحقاقه التقاعدي عن كل شهر خدمة إضافي بعد 9 سنوات، على ألا يتجاوز المعاش التقاعدي ما يعادل ثلثي المرتب الأساسي الصافي السنوي (بدون تسوية مقر العمل).

(b) A new subparagraph (b) is inserted, which reads as follows: " If the member has served for more than nine years, he/she shall receive one three-hundredth of his or her retirement benefit for each further month beyond nine years, up to a maximum pension of two thirds of the amount of the annual net base salary (excluding post adjustment) " ;
(ب) تدرج فقرة فرعية جديدة (ب) نصها كالتالي: " إذا خدم العضو لأكثر من تسع سنوات، فإنه يتقاضى ما يساوي جزء واحد من ثلاثمائة جزء من معاشه التقاعدي عن كل شهر إضافي يمضيه في الخدمة بعد تسع سنوات، على ألا يتجاوز المعاش التقاعدي ما يعادل ثلثي المرتب الأساسي الصافي السنوي (باستثناء تسوية مقر العمل) " ؛

For a member of the Court who is re-elected, the pension entitlement is increased by an additional $250 per month for each further month of service, up to a maximum pension of $75,000 a year.
أما عضو المحكمة الذي يعاد انتخابه، فيزيد استحقاق المعاش التقاعدي خاصته بمبلغ شهري إضافي قدره ٢٥٠ دولار عن كل شهر خدمة إضافي، بحد أقصى للمعاش التقاعدي قدره ٠٠٠ ٧٥ دولار في السنة.

Surviving spouses receive a maximum pension benefit of 50 per cent; however, if a judge leaves children under the age of 22, the spouse's pension is increased by 10 per cent for one child and by 20 per cent for two or more children; the maximum pension of the spouse in that event would for a time be 70 per cent.
ويتقاضى الزوج المترمل معاشا تقاعديا بحد أقصى ٥٠ في المائة؛ وفي حالة ترك القاضي أبناء تقل أعمارهم عن ٢٢ سنة يزيد المعاش التقاعدي للزوج المترمل بنسبة ١٠ في المائة إذا توفي القاضي عن إبن واحد، وعشرين في المائة إذا توفي عن إبنين فأكثر، على أن يكون الحد اﻷقصى للمعاش التقاعدي في هذه الحالة هو ٧٠ في المائة من المرتب.

(b) If the member has served for more than nine years, he/she shall receive one three-hundredth of his or her retirement benefit for each further month beyond nine years, up to a maximum pension of two thirds of the amount of the annual net base salary (excluding post adjustment);
(ب) إذا قضى العضو في الخدمة فترة تزيد عن تسع سنوات، فإنه يتقاضى واحدا من ثلاثمائة من استحقاقه التقاعدي عن كل شهر إضافي يمضيه في الخدمة بعد تسع سنوات، على ألا يتجاوز المعاش التقاعدي ما يعادل ثلثي المرتب الأساسي الصافي السنوي (باستثناء تسوية المقر)؛

(e) A member of the International Court of Justice who is re-elected should receive one three-hundredth of his or her retirement benefit for each further month of service beyond nine years, up to a maximum pension of two thirds of annual net base salary (excluding post adjustment) [emphasis added];
(هـ) أن يتقاضى عضو محكمة العدل الدولية الذي يعاد انتخابه واحدا من ثلاثمائة من استحقاقه التقاعدي عن كل شهر إضافي يمضيه في الخدمة بعد 9 سنوات، على ألا يتجاوز المعاش التقاعدي ما يعادل ثلثي المرتب الأساسي الصافي السنوي (باستثناء تسوية مقر العمل) [التأكيد مضاف]؛

Also decides that a member of the International Tribunal for the Law of the Sea who is re-elected should receive one three-hundredth of his or her retirement benefit for each further month beyond nine years, up to a maximum pension of two thirds of the annual net base salary, excluding post adjustment;
5 - يقرر أيضا أن يتقاضى عضو المحكمة الدولية لقانون البحار الذي يعاد انتخابه واحدا من ثلاثمائة من استحقاقه التقاعدي عن كل شهر إضافي يمضيه في الخدمة بعد تسع سنوات، على ألا يتجاوز المعاش التقاعدي ما يعادل ثلثي المرتب الأساسي الصافي السنوي باستثناء تسوية مقر العمل؛

5.11 As decided by the General Assembly in its resolution 45/250 B, the pension entitlement of a member of the International Court of Justice who has served a full term of nine years should be $50,000 a year and the pension entitlement of a member of the Court who is re-elected should be increased by an additional $250 per month for each further month of service up to a maximum pension of $75,000 per year.
٥-١١ وفقا لما قررته الجمعية العامة في قرارها ٤٥/٢٥٠ باء، يتقاضى عضو محكمة العدل الدولية الذي أمضى في الخدمة تسع سنوات كاملة معاشا تقاعديا قدره ٠٠٠ ٥٠ دولار سنويا، ويزاد المعاش التقاعدي لعضو المحكمة الذي يعاد انتخابه بمبلغ إضافي قدره ٢٥٠ دولارا شهريا عن كل شهر خدمة إضافي على ألا يتجاوز المعاش التقاعدي ٠٠٠ ٧٥ دولار سنويا.

5. As decided by the General Assembly in its resolution 45/250 B of 21 December 1990, the pension entitlement of a member of the Court who has served a full term of nine years should be $50,000 a year and the pension entitlement of a member of the Court who is re-elected should be increased by an additional $250 per month for each further month of service up to a maximum pension of $75,000 per year.
٥-١١ وفقا لما قررته الجمعية العامة في قرارها ٤٥/٢٥٠ باء المؤرخ ٢١ كانون اﻷول/ ديسمبر ١٩٩٠، يتقاضى عضو محكمة العدل الدولية الذي أمضى في الخدمة تسع سنوات كاملة معاشا تقاعديا قدره ٠٠٠ ٥٠ دولار سنويا، ويزاد المعاش التقاعدي لعضو المحكمة الذي يعاد انتخابه بمبلغ إضافي قدره ٢٥٠ دولارا شهريا عن كل شهر خدمة إضافي على ألا يتجاوز المعاش التقاعدي ٠٠٠ ٧٥ دولار سنويا.

٥-٢١ وفقا لما قررته الجمعية العامة في قرارها ٥٤/٠٥٢، يتقاضى كل عضو في محكمة العدل الدولية، أمضى في الخدمة تسع سنوات كاملة معاشا تقاعديا قدره ٠٠٠ ٠٥ دولار سنويا، ويزاد المعاش التقاعدي لعضو المحكمة الذي يعاد انتخابه بمبلغ إضافي قدره ٠٥٢ دولارا شهريا عن كل شهر خدمة إضافي على ألا يتجاوز المعاش التقاعدي ٠٠٠ ٥٧ دولار سنويا.

18. As decided in the case of the International Court of Justice, with regard to the retirement benefit payable for service beyond nine years, it is also proposed that a member of the Tribunal who is re-elected should receive one three-hundredth of his or her retirement benefit for each further month of service beyond nine years, up to a maximum pension of two thirds of the annual net base salary, excluding post adjustment.
18 - وكما تقرر في حالة محكمة العدل الدولية فيما يتعلق باستحقاقات التقاعد لخدمة تزيد عن تسع سنوات، اقترح أيضا أن يتقاضى عضو محكمة قانون البحار الذي يعاد انتخابه واحدا من ثلاثمائة من استحقاقه التقاعدي عن كل شهر إضافي يمضيه في الخدمة بعد تسع سنوات على ألا يتجاوز المعاش التقاعدي ما يعادل ثلثي المرتب الأساسي الصافي السنوي، باستثناء تسوية مقر العمل.

For members of the Court who were re-elected, the pension entitlement was increased by an additional $250 per month for each further month of service, up to a maximum pension of $75,000 a year.
وأما أعضاء محكمة العدل الدولية الذين يُعاد انتخابهم، فترفع استحقاقاتهم من المعاش التقاعدي بمبلغ إضافي قدره 250 دولارا عن كل شهر إضافي في الخدمة، بحـد أقصى للمعاش التقاعدي قدره 000 75 دولار سنوياً.

2.23 Under the pension regime in effect prior to 1 January 1991, the scheme provided a pension of 50 per cent of annual salary after completion of nine years of service with an additional one three hundredth of that amount for each additional month in service, subject to a maximum pension of two thirds of annual salary.
٢-٢٣ بموجب نظام المعاشات التقاعدية الساري قبل ١ كانون الثاني/يناير عام ١٩٩١، توفر الخطة معاشا تقاعديا يمثل ٥٠ في المائة من المرتب السنوي بعد استكمال تسع سنوات من الخدمة مع تقديم مبلغ إضافي قدره واحد على ثلاثمائة من ذلك المبلغ عن كل شهر إضافي من شهور الخدمة، على أن يعادل الحد اﻷقصى للمعاش التقاعدي ثلثي المرتب السنوي.
