Regarding paragraph 6, the Office of the United Nations High Commissioner for Refugees (UNHCR) recommended in document A/AC.254/L.10 that the wording be amended to “Extradition shall not be granted if, from the circumstances of the case, it can be inferred that persecution for reasons of race, religion, nationality, membership of a particular social group or political opinion is involved ...”.

Each application for refugee status is considered on its individual merit to determine whether the applicant has demonstrated a well-founded fear of persecution in his or her home country for reasons of race, religion, nationality, membership of a particular social group or political opinion.

This principle, embodied in Article 33 of the 1951 Convention, prohibits the expulsion and return of refugees in any manner whatsoever to the frontiers of territories where their lives or freedom may be threatened on account of their race, religion, nationality, membership of a particular social group or political opinion.

According to the Convention and the Protocol thereto, a refugee is someone who, owing to a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group, or political opinion, is outside the country of his nationality, and is unable or, owing to such fear, is unwilling to avail himself of the protection of that country.

As a high contracting party to the Convention relating to the Status of Refugees, moreover, it was bound by the nonrefoulement principle in that it was prohibited to expel or return a refugee in any manner whatsoever to the frontiers of territories where his or her life or freedom would be threatened on account of his or her race, religion, nationality, membership of a particular social group or political opinion.

The Office of the High Commissioner (UNHCR) encourages countries to consider that rape or other forms of sexual violence, when committed as measures of oppression against a person's race, religion, nationality, membership of a particular social group or political opinion, and particularly when such actions are condoned by the authorities concerned, should be grounds for asylum.
١٧١- وتشجع مفوضية اﻷمم المتحدة لشؤون اللاجئين البلدان على اعتبار الاغتصاب أو غيره من أشكال العنف الجنسي، عندما تقترف كتدابير قمع ضد عرق شخص ما أو دينه أو جنسيته أو انتمائه إلى فئة اجتماعية معينة أو آرائه السياسية، ولا سيما عندما تتغاضى السلطات المعنية عن هذه اﻷفعال، أساساً لمنح مركز اللاجئ.

١٤- لا يجوز طرد اللاجئ أو رده على أعقابه إلى مكان تكون فيه حياته أو حريته مهددة بسبب عرقه أو دينه أو جنسيته أو انتمائه إلى فئة اجتماعية معينة أو آرائه السياسية)١٢(.

Cambodia is a party to the Convention relating to the Status of Refugees and obliged under international law not to return any person to a country where his or her life or freedom may be threatened on account of his race, religion, nationality, membership of a particular social group or political opinion.

134- نحث الدول على اتخاذ التدابير اللازمة لتأمين ألا يُطرد أحد أو يُسلَّم أو يعاد إلى دولة أخرى توجد فيها أسباب موضوعية تدعو إلى اعتقاد أنه سيكون فيها معرضا لخطر التعذيب أو الاضطهاد بسبب عرقه أو دينه أو قوميته أو انتمائه إلى فئة اجتماعية معينة أو تبنيه لرأي سياسي معين؛

Refugees are those who have to flee due to a " well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion " (art. 1).

10. Article 33 of the Convention relating to the Status of Refugees provides that States parties have an obligation not to expel or return a refugee to a place where their life or freedom would be threatened on account of race, religion, nationality, membership of a particular social group or political opinion.
10- وتنص المادة 33 من الاتفاقية الخاصة بوضع اللاجئين على أن الدول الأطراف ملزمة بعدم طرد أو إعادة لاجئ إلى مكان تكون حياته أو حريته مهددة فيها بسبب عرقه أو دينه أو جنسيته أو انتمائه إلى فئة اجتماعية معينة أو بسبب آرائه السياسية.

The Executive Committee urged States to respect and ensure the fundamental right to personal security, and to recognize as refugees persons whose claim to refugee status is based on a well-founded fear of persecution, through sexual violence, for reasons of race, religion, nationality, membership of a particular social group, or political opinion.
وحثت اللجنة التنفيذية الدول على احترام وكفالة الحق اﻷساسي في اﻷمن الشخصي، وأن يعترف بمركز اللاجئ لمن يستند التماسه هذا المركز إلى خوف من الاضطهاد له ما يبرره، سواء كان ذلك بواسطة العنف الجنسي، أو ﻷسباب الجنس أو الدين أو الجنسية أو الانتماء إلى فئة اجتماعية معينة أو آراء سياسية.
