The Committee requests the State party to provide information on the progress made in the field of mental and psychosocial health in its next periodic report.

Taking into account the information received during the consideration of the report on plans regarding mental health care, the Committee remains concerned at the lack of focus on alternatives to hospitalization of persons with mental and psychosocial disabilities.

(a) Ensure effective supervision and independent monitoring by judicial organs of any involuntary hospitalization in psychiatric institutions of persons with mental and psychosocial disabilities; and ensure that every patient, whether voluntarily or involuntarily hospitalized, is fully informed about the treatment to be prescribed and given the opportunity to refuse treatment or any other medical intervention;
(أ) تضمن إشراف الأجهزة القضائية الفعال ورصدها المستقل لإدخال أي شخص ذي إعاقة عقلية ونفسية اجتماعية دون موافقته إلى مؤسسات الطب النفسي؛ وتضمن تلقي أي مريض، سواء أُدخل المستشفى طواعية أو بشكل غير طواعي، معلومات كاملة عن العلاج الذي سيُوصف له ويُعطى فرصة رفض العلاج أو أي تدخل طبي آخر؛

The Committee notes with concern the continued use of net beds and other forms of non-consensual practices in the State party's psychiatric hospitals and institutions where people with intellectual, mental and psychosocial disabilities are confined.
32- تلاحظ اللجنة بقلق استمرار استخدام الأسرّة الشبكية وغير ذلك من أشكال الممارسات القسرية في مستشفيات الأمراض العقلية والمؤسسات التي يودع فيها الأشخاص ذوو الإعاقة الفكرية والعقلية والنفسية الاجتماعية في الدولة الطرف.

30. The Committee is concerned by the absence of sufficient, disaggregated, up-to-date mental and psychosocial health statistics in the State party.
30- وتعرب اللجنة عن قلقها إزاء غياب إحصاءات كافية ومصنفة ومحدثة عن الصحة العقلية والنفسية في الدولة الطرف.

The recent conflict poses a profound and continuing challenge to the mental and psychosocial well-being of many.

The Committee is particularly concerned about the lack of access to adequate health-care services for women and girls with disabilities, including mental and psychosocial disabilities.

The Committee strongly urges the State party to reform the Mental Health Treatment Act to protect the rights of persons with psychosocial disabilities and to take effective steps to raise awareness about the full and equal human rights of people with mental and psychosocial disabilities.

21. The Committee is concerned at the high numbers of persons with mental and psychosocial disabilities who are held in mental health care institutions on an involuntary basis, often for a lengthy period of time.

20. While taking note of the 1 September 2012 amendments to the Mental Health Act, the Committee is concerned by reports of shortcomings in judicial oversight regarding the involuntary hospitalization and forced medication of persons with mental and psychosocial disabilities in psychiatric institutions.
20- تحيط اللجنة علماً بتعديلات 1 أيلول/سبتمبر 2012 لقانون الصحة العقلية ولكنها تعرب عن قلقها إزاء التقارير المتعلقة بنواحي القصور في الرقابة القضائية المتعلقة بدخول الأشخاص ذوي الإعاقة العقلية والنفسية الاجتماعية غير الطوعي إلى مؤسسات الطب النفسي وتناولهم القسري للأدوية.

(21) The Committee is concerned at the high numbers of persons with mental and psychosocial disabilities who are held in mental health care institutions on an involuntary basis, often for a lengthy period of time.

(b) Establish an independent complaints mechanism and counsel and effectively, promptly and impartially investigate all complaints of ill-treatment of persons with mental and psychosocial disabilities in psychiatric institutions, bring those responsible to justice and provide redress;
(ب) تنشئ آلية مستقلة لتقديم الشكاوى، وتسدي المشورة، وتجري تحقيقاً فعالاً وفورياً ونزيهاً في جميع الشكاوى المتعلقة بإساءة معاملة الأشخاص ذوي الإعاقة العقلية والنفسية - الاجتماعية في مؤسسات الطب النفسي، وتقدم الجناة إلى العدالة، وتوفر سبل الانتصاف؛

(c) Ensure effective legal safeguards for all persons with mental and psychosocial disabilities and comply with the recommendations of the Ombudsman regarding the keeping of records in such a way that a patient's consent is requested both in hospitalizing him or her and determining his or her psychiatric medical treatment in the institutions.
(ج) تكفل ضمانات قانونية فعالة لجميع الأشخاص ذوي الإعاقة العقلية والنفسية - الاجتماعية، وتمتثل لتوصيات أمين المظالم بشأن حفظ السجلات بحيث يشترط موافقة المريض سواء عند إدخاله المستشفى أو عند تحديد علاجه النفسي في المؤسسات.

(20) While taking note of the 1 September 2012 amendments to the Mental Health Act, the Committee is concerned by reports of shortcomings in judicial oversight regarding the involuntary hospitalization and forced medication of persons with mental and psychosocial disabilities in psychiatric institutions.
(20) تحيط اللجنة علماً بتعديلات 1 أيلول/سبتمبر 2012 لقانون الصحة العقلية ولكنها تعرب عن قلقها إزاء التقارير المتعلقة بنواحي القصور في الرقابة القضائية المتعلقة بدخول الأشخاص ذوي الإعاقة العقلية والنفسية الاجتماعية غير الطوعي إلى مؤسسات الطب النفسي وتناولهم القسري للأدوية.

(c) Ensure the right of persons with mental and psychosocial disabilities or their legal guardians to be sufficiently informed about criminal proceedings and charges against them, the right to a fair hearing and the right to adequate and effective legal assistance for their defence;
(ج) تكفل حق الأشخاص ذوي الإعاقة العقلية والنفسية الاجتماعية أو أوصيائهم الشرعيين في تلقي معلومات كافية عن الإجراءات الجنائية والتهم الموجهة إليهم، والحق في محاكمة عادلة، والحق في مساعدة قانونية كافية وفعالة لدفاعهم؛

The Committee recommends that the State party abolish the use of net beds, restraints and other non-consensual practices with regard to persons with intellectual, mental and psychosocial disabilities in psychiatric hospitals and institutions.
33- توصي اللجنة الدولة الطرف بإبطال استخدام الأسرّة الشبكية وأدوات الكبح وغير ذلك من الممارسات القسرية التي يتعرض لها الأشخاص ذوو الإعاقة الفكرية والعقلية والنفسية الاجتماعية المودعين في مستشفيات ومؤسسات الأمراض العقلية.
