Three basic approaches to legislative measures in regard to combating Mercenarism in Africa were evident:

The International Convention broadens the scope of international law regarding the prohibition of the activities of mercenaries, currently limited mainly to article 47 of the 1977 Protocol I Additional to the Geneva Conventions of 1949 and the 1977 Organization of African Unity (OAU) Convention on the Elimination of Mercenarism in Africa.

The Convention for the Elimination of Mercenarism in Africa was indeed a useful document which could certainly benefit other initiatives around the world.

Its failure to enter into force nine years after its adoption means that international legislation on mercenaries continues to be limited to article 47 of the 1977 Protocol I Additional to the Geneva Conventions of 1949 and the 1977 OAU Convention on the Elimination of Mercenarism in Africa.

Since the Convention has still not entered into force nearly 10 years after its adoption, international law on mercenaries continues to be limited to the provisions of article 47 of the 1977 Protocol I Additional to the Geneva Conventions of 1949 and the 1977 OAU Convention on the Elimination of Mercenarism in Africa.

The Special Rapporteur also notes that Zimbabwe and Equatorial Guinea are parties to the Convention for the Elimination of Mercenarism in Africa of the Organization of African Unity (OAU) and commends the actions undertaken thus far by those Governments in line with the Convention.

According to the status list for those countries that have ratified the 1977 Organization of African Unity Convention for the Elimination of Mercenarism in Africa, only the Gambia, Ghana, Lesotho, Nigeria and Zimbabwe have ratified the Convention.

٣١١- وتؤكد الاتفاقية الدولية الطابع القضائي لقرارات هيئات اﻷمم المتحدة وإعلاناتها التي تدين أنشطة المرتزقة وتعمل على توسيع نطاق اللوائح الدولية الناظمة لهذه المسألة حيث إن هذه اللوائح تقتصر بصفة أساسية، في الوقت الراهن، على المادة ٧٤ من البروتوكول اﻹضافي اﻷول لاتفاقيات جنيف لعام ٩٤٩١ الذي اعتمد في عام ٧٧٩١ وعلى اتفاقية منظمة الوحدة اﻷفريقية للقضاء على الارتزاق في أفريقيا لعام ٧٧٩١.

It did not find that these fighters were promised or paid material compensation substantially in excess of that promised or paid to local Qadhafi forces, a requirement for these individuals or groups to fall within the definition of a " mercenary " under the International Convention against the Recruitment, Use, financing and Training of Mercenaries or under the Convention for the Elimination of Mercenarism in Africa.
