1. States Parties shall facilitate, whenever necessary, the repatriation to the State of origin of the bodies of deceased migrant workers or members of their families.
1- تقوم الدول الأطراف، حيثما اقتضت الضرورة، بتسهيل إعادة جثث العمال المهاجرين أو أفراد أسرهم الذين يتوفون إلى دولة المنشأ.

38. Article 17, paragraph 3, underlines the non-punitive nature of administrative detention. It provides for migrant workers or members of their families who are detained for violation of provisions relating to migration to be held, insofar as is practicable, separately from convicted persons or pretrial detainees.
38- وتؤكد الفقرة 3 من المادة 17 على الطابع غير العقابي للاحتجاز الإداري، وتنص على وضع العمال المهاجرين أو أفراد أسرهم الذين يُحتجزون بسبب خرق الأحكام المتعلقة بالهجرة، كلما كان ذلك ممكناً عملياً، بمعزل عن الأشخاص المدانين أو الأشخاص المحتجزين رهن المحاكمة.

(d) The limited accessibility of information and legal aid to appeal detention orders against migrant workers or members of their families; and

(c) Measures to impose effective sanctions on persons, groups or entities which use violence, threats or intimidation against migrant workers or members of their families in an irregular situation.
(ج) تدابير لفرض جزاءات فعالة على الأشخاص أو الجماعات أو الكيانات الذين يستخدمون العنف أو التهديد أو التخويف ضد العمال المهاجرين أو أفراد أسرهم الذين هم في وضع غير نظامي.

15. Article 35 of the Convention clarifies that the fact that Part III protects the rights of all migrant workers and members of their families, irrespective of their migration status, cannot be interpreted as implying the regularization of the situation of migrant workers or members of their families in an irregular situation or any right to such regularization.
15- توضح المادة 35 من الاتفاقية أنه لا يجب تفسير الجزء الثالث الذي يوفر الحماية لجميع العمال المهاجرين وأفراد أسرهم، بغض النظر عن وضع هجرتهم، تفسيراً يعني ضمناً تسوية وضع هؤلاء العمال المهاجرين أو أفراد أسرهم الذين يكونون في وضع غير نظامي، أو إعطاءهم أي حق في مثل هذه التسوية.

While States parties have no obligation to regularize the situation of migrant workers or members of their families, they shall take appropriate measures, whenever migrant workers or members of their families within their territory are in an irregular situation, to ensure that such a situation does not persist (art. 69, para. 1).
وفي حين أن الدول الأطراف ليست ملزمة بتسوية وضع العمال المهاجرين أو أفراد أسرهم، فإنه يتعين عليها أن تتخذ، حين يوجد في أراضيها عمال مهاجرون يكونون هم وأفراد أسرهم في وضع غير نظامي، تدابير ملائمة لضمان عدم استمرار هذا الوضع (الفقرة 1 من المادة 69).

22. The Committee recommends that the State party bring Law No. 04/2011 of 21 March 2011 on immigration to and emigration from Rwanda into conformity with the spirit of the Convention, with a view to decriminalizing immigration offences committed by migrant workers or members of their families, treating such violations as administrative offences and establishing appropriate penalties for offences of this kind.
22- توصي اللجنة الدولة الطرف بمواءمة القانون رقم 04/2011 المؤرخ 21 آذار/مارس 2011 والمتعلق بالهجرة من رواندا وإليها مع روح الاتفاقية وذلك من أجل نزع الصفة الجرمية عن مخالفة العمال المهاجرين أو أفراد أسرهم لقوانين الهجرة واعتبار هذه المخالفات مخالفات إدارية والنص على عقوبات ملائمة لهذا النوع من المخالفات.
