15. On or around 24 October 2008, the military-appointed judge charged Mr. Min Ko Niang and Mr. Pyone Cho with contempt of court for requesting their family members to be permitted to attend the trial.

Mr. Min Ko Naing and Mr. Pyone Cho have been sentenced by the Northern District Court conducting the trial on the premises of Insein Prison to imprisonment of six months for contempt of court in response to their verbal appeal to the judge for free and fair justice.

A. Political prisoners 21. In his last report to the Human Rights Council, the Special Rapporteur noted with satisfaction the decision by the Government of Myanmar in January 2007 to release more than 40 political prisoners, including Min Ko Naing, Ko Ko Gyi, Pyone Cho, Min Zeya and Htay Kywe.

19. Mr. Min Zayar; Mr. Pyone Cho and Mr. Min Ko Naing were already the subject of a joint urgent appeal sent by the Chairperson-Rapporteur of the Working Group on Arbitrary Detention, together with other Special Procedures mandate holders of the Human Rights Council, on 6 October 2006, to which the Government of Myanmar responded on 8 December 2006.
19- وكان رئيس - مقرر الفريق العامل المعني بالاحتجاز التعسفي قد وجه بالفعل نداءً عاجلاً مشتركا مع حملة ولايات الإجراءات الخاصة الآخرين في مجلس حقوق الإنسان يوم 6 تشرين الأول/أكتوبر 2006 بشأن السيد مين زايار؛ والسيد بيون شو؛ والسيد مين كو نانغ، وردت عليه حكومة ميانمار في 8 كانون الأول/ديسمبر 2006.

(c) Mr. Min Ko Naing, named at birth as Paw Oo Tun, born on 18 October 1962, citizen of Myanmar, usually addressed at Thingangyun Township, Rangoon, and a member of " the 88 Generation " , was arrested on 22 August 2007 at his home by military officers.
(ج) السيد مين كو نانغ، المسمى عند الميلاد باو أو تون، ولد يوم 18 تشرين الأول/أكتوبر 1962، وهو من مواطني ميانمار، ويقيم في العادة في بلدة ثينغانغيون في رانغون، وهو عضو في " جيل 88 " ، وألقي القبض عليه يوم 22 آب/أغسطس 2007 في مسكنه على يد ضباط من الجيش.

(c) The Government further informs that legal proceedings are under way to prosecute Mr. Min Zayar, Mr. Kyaw Min Yu, Mr. Min Ko Naing and Mr. Pyone Cho as well as to those who are in connection with the members of " the 88 Generation Students " movement.
(ج) وتقول الحكومة كذلك في ردها إنه يجري تطبيق الإجراءات القانونية في مقاضاة السيد مين زايار، والسيد كياو مين يو، والسيد مين كو نانغ، والسيد بيون شو والأشخاص المتصلين بأعضاء حركة " طلبة جيل 88 " .

30. The 88 Generation student group members Min Ze Ya, Paw U Tun (alias Min Ko Naing), Ko Ko Gyi, Pyone Cho (alias Htay Win Aung), Aung Thu, Kyaw Kyaw Htwe (alias Marky), Kyaw Min Yu (alias Jimmy), Mya Aye (alias Thu Ya) and Yin Htoo Aung, all arrested following the demonstrations, have been reportedly charged under section 17/20 of the Printers and Publishers Registration Act.
30- وقد تم بعد التظاهرات إلقاء القبض على أعضاء مجموعة طلاب جيل اﻟ 88، وهم مين زي يا، وباو يو تون (الملقَّب مين كو نينغ)، وكوكو جيي، وبيوني تشو (الملقَّب هتي وين أيونغ)، وأيونغ ثو، وكياوا كياوا هتو (الملقَّب ماركي) وكياوا مين يو (الملقَّب جيمي) وميا أيي (الملقَّب تو يا) ويين هتوو أيونغ.

2. Strongly urges the Government of Myanmar to desist from further politically motivated arrests, to release without delay and without condition all political prisoners, including the General Secretary of the National League for Democracy, Daw Aung San Suu Kyi, the Chairman of the Shan Nationalities League for Democracy, U Khun Tun Oo and the leader of the 88 Generation Students Group, U Min Ko Naing;

He heard reports that 10 political prisoners had their sentences extended for seven years in November 2001 and, more recently, that student leader Paw U Tun (Min Ko Naing), who in 1998 had completed his 10-year sentence for participating in a pro-democracy protest, continued to be held without new charges being brought against him.

While estimates vary, a significant number of those released were prisoners of conscience, including former Prime Minister Khin Nyunt and the Chairperson of the Shan Nationalities League for Democracy, Khun Htun Oo, members of the 88 Generation Students Group, including Min Ko Naing, monks jailed for their role in the 2007 demonstrations, and activists and journalists.

Information was received with regard to the health situation of Paw U Tun (alias Min Ko Naing), a member of the 88 Generation Students group active in the demonstrations against the sharp rise in fuel prices in August 2007; Paw U Tun has reportedly been suffering from a severe eye infection while in detention.
