It was suggested that the term " mobile " should not refer to mobile phones but rather to the mobility of devices, as restricting any definition of mobile commerce to mobile phones might exclude other mobile handheld devices that equally enable ubiquitous computing.
34- وأشير إلى أنَّ مصطلح " نقال " ينبغي ألا يؤخذ على أنه إشارة إلى الهواتف النقالة بل يعتبر إشارة إلى إمكانية نقل وحمل الأجهزة، لأنَّ تقييد تعريف التجارة النقالة بالهواتف النقالة قد يستبعد استخدام أجهزة أخرى محمولة باليد تتيح إمكانيات حاسوبية مماثلة للاتصال من أيِّ مكان.

It was noted that one impediment to mobile commerce was the so-called " media discontinuity " occurring when users were required to switch to other means to initiate or complete a procedure.
40- ولُوحِظ أنَّ من العوائق التي تعرقل التجارة النقالة ما يُسمَّى " بانقطاع الوسائط " () الذي يحصل عندما يضطر المستخدم إلى التحوّل إلى وسيلة أخرى لاستهلال إجراء ما أو إتمامه.

It was added that such work would also clarify the scope of provisions on legal signatures contained in existing UNCITRAL texts, and would facilitate the treatment of identity management in the context of other topics potentially of interest for UNCITRAL and discussed at the colloquium, namely mobile commerce, electronic transferable records and electronic single windows facilities.
وأُضِيف أنَّ من شأن هذا العمل أن يوضح أيضا نطاق الأحكام المتعلقة بالتوقيعات القانونية الواردة في نصوص الأونسيترال القائمة، ومن شأنه أن يسهّل معالجة موضوع إدارة الهوية في سياق المواضيع الأخرى التي نُوقِشت في الندوة والتي قد تهم الأونسيترال، أي التجارة النقالة والسجلات الإلكترونية القابلة للإحالة ومرافق النوافذ الإلكترونية.

On the one hand, it was suggested that electronic commerce and mobile commerce shared significant technical similarities (see also A/65/17, para. 249) and that therefore the existing legal framework for electronic communications and electronic commerce, including provisions of UNCITRAL texts, might suffice to address legal issues arising from mobile commerce.
31- وأُشِير من ناحية، إلى أنَّ ثمة أوجه تشابه تقنية كبيرة مشتركة بين التجارة الإلكترونية والتجارة النقالة (انظر أيضا الفقرة 249 من الوثيقة A/65/17)، وأنه قد يكون بذلك الإطار القانوني القائم للاتصالات الإلكترونية والتجارة الإلكترونية، بما في ذلك أحكام نصوص الأونسيترال، إطارا كافيا لمعالجة المسائل القانونية الناشئة عن التجارة النقالة.

On the other hand, it was indicated that mobile commerce presented, and was likely to retain for the foreseeable feature, peculiar features due to the specificities of mobile devices (for more information on such specificities, see below, paras. 33-34, 36 and 40-44), and that those features might deserve dedicated legal treatment.
32- ومن ناحية أخرى، أُشِير إلى أنَّ التجارة النقالة تتصف بسمات معينة بسبب أوجه الخصوصية التي تتسم بها الأجهزة النقالة، ومن المُرجّح أن تحتفظ بهذه السمات في المستقبل المنظور (انظر الفقرات 33 و34 و36 والفقرات 40 إلى 44 الواردة أدناه للاطلاع على مزيد من المعلومات عن أوجه الخصوصية المذكورة)، وإلى أنَّ تلك السمات قد تستحق معالجتها معالجة قانونية على حدة.
