21. At the recent session of the Committee, there had been serious and in-depth discussion of the Convention on International Interests in Mobile Equipment and the preliminary draft protocol on matters specific to space assets.
21 - وأشار إلى أن الدورة الأخيرة للجنة شهدت نقاشا جادا ومتعمقا بشأن اتفاقية الضمانات الدولية على المعدات المنقولة والمشروع الأولي للبروتوكول المتعلق بالمسائل التي تخص الموجودات الفضائية.

Note: Although they are not United Nations agencies, it may be noted that IATA cooperates with the World Tourism Organization on aviation and the General Agreement on Trade in Services and with the International Institute for the Unification of Private Law (UNIDROIT) on the proposed UNIDROIT Convention on International Interests in Mobile Equipment and Aircraft Equipment Protocol.

Intensive discussion was given by the Subcommittee to new agenda items for its next session and it was agreed to consider the draft convention prepared by the International Institute for the Unification of Private Law on international interests in Mobile Equipment and the preliminary draft protocol thereto on matters specific to space property.
وقد أجرت اللجنة الفرعية مناقشات ضافية حول البنود الجديدة التي ستدرج في جدول أعمال دورتها القادمة، ووفق على النظر في مشروع الاتفاقية بشأن المصالح الدولية في المعدات المتنقلة الذي أعده المعهد الدولي لتوحيد القانون الخاص، وفي المشروع الأولي للبروتوكول الملحق بها بشأن مسائل تتعلق على التحديد بالممتلكات الفضائية.

Some delegations expressed the view that the Convention on International Interests in Mobile Equipment and the protocol on matters specific to space assets had a significant potential to promote the financing of space activities, with particular benefit to developing countries and countries with economies in transition.
121- وأعربت بعض الوفود عن رأي بأن اتفاقية الضمانات الدولية على المعدات المنقولة والبروتوكول المتعلق بالمسائل الخاصة بالموجودات الفضائية ينطويان على إمكانات كبيرة لتعزيز تمويل الأنشطة الفضائية، وخصوصا فيما يعود بالنفع على البلدان النامية والبلدان ذات الاقتصادات الانتقالية.

Such a rule may be based on national law (see A/CN.9/631, recommendation 202) or international conventions, which take precedence (e.g. the International Institute for the Unification of Private Law (Unidroit) Convention on International Interests in Mobile Equipment and the relevant protocols thereto).

16. With regard to the work of the Legal Subcommittee, he said that the Subcommittee had continued its intense and in-depth consideration of the agenda item entitled " Consideration of the Convention on International Interests in Mobile Equipment and the preliminary draft Protocol on Matters Specific to Space Assets " .
16 - وفيما يتصل باللجنة الفرعية القانونية، قال إنها واصلت المناقشة المتعمقة لبند جدول الأعمال المعنون " النظر في اتفاقية الضمانات الدولية على المعدات المنقولة وفي المشروع الأولـي للبروتوكول المتعلق بالمسائل الخاصة بالموجودات الفضائية " .

21. This delegation noted with satisfaction that in accordance with General Assembly resolution 56/51 of 10 December 2001, the Legal Subcommittee of the Committee on the Peaceful Uses of Outer Space had considered the Convention on International Interests in Mobile Equipment and the preliminary draft Protocol on Matters Specific to Space Assets.
21 - وأعلن أن وفده لاحظ بارتياح نظر اللجنة الفرعية القانونية التابعة للجنة استخدام الفضاء الخارجي في الأغراض السلمية، عملا بقرار الجمعية العامة 56/51 المؤرخ 10 كانون الأول/ديسمبر 2001، في اتفاقية الضمانات الدولية على المعدات المنقولة وفي مشروع البروتوكول الأولي المتعلق بالمسائل الخاصة بالموجودات الفضائية الملحق بها.

(e) The relationship between the Convention on International Interests in Mobile Equipment and the Protocols thereto and the draft Unidroit Model Law on Leasing continued to be examined, most recently by the Unidroit Committee of Governmental Experts in Johannesburg, South Africa.
(هـ) أن العلاقة بين الاتفاقية بشأن الضمانات الدولية على المعدات المنقولة والبروتوكولات الملحقة بها ومشروع القانون النموذجي لليونيدروا بشأن التأجير الشرائي لا تزال قيد الدراسة، وقد نظرت فيها مؤخرا لجنة الخبراء الحكوميين في جوهانسبرغ، جنوب أفريقيا.

Some delegations expressed the view that the Convention on International Interests in Mobile Equipment and the future protocol on matters specific to space assets would bring benefits to countries at different levels of economic and technological development and enable less developed countries, in particular, to take an active part in space activities by reducing the financial risk and burden arising from those activities.
174- ورأت بعض الوفود أن اتفاقية الضمانات الدولية في المعدات المنقولة والبروتوكول المقبل بشأن المسائل الخاصة بالموجودات الفضائية سوف يحققان فوائد لبلدان تتباين مستويات تطورها الاقتصادي والتكنولوجي، مع تمكين أقل البلدان نموا بوجه خاص من المشاركة الفعّالة في أنشطة فضائية عن طريق تخفيف المخاطرة المالية والأعباء الناشئة من هذه الأنشطة.

The Subcommittee agreed that agenda item 8 should be reformulated to read " Examination and review of the developments concerning the draft protocol on matters specific to space assets to the Convention on International Interests in Mobile Equipment " , and should remain on the agenda of the Subcommittee, in this modified form, at its forty-fifth session.
115- واتفقت اللجنة الفرعية على إعادة صياغة البند 8 من جدول الأعمال بحيث يكون نصه: " دراسة واستعراض التطورات المتعلقة بمشروع البروتوكول المتعلق بالمسائل الخاصة بالموجودات الفضائية، الملحق بالاتفاقية المتعلقة بالضمانات الدولية على المعدات المنقولة " ، وعلى أن يبقى على جدول أعمال اللجنة الفرعية، في هذا الشكل المعدّل، في دورتها الخامسة والأربعين.

Some delegations expressed the view that the Convention on International Interests in Mobile Equipment and the future protocol to the Convention would contribute to the expansion of the space activities of developing countries, as well as developed countries, by reducing the financial risks and burdens arising from such an increase in space activities.
73- وأعرب بعض الوفود عن رأي مؤداه أن اتفاقية المصالح الدولية في المعدات المتنقلة والبروتوكول المقبل الملحق بتلك الاتفاقية سيساعدان على توسع الأنشطة الفضائية للبلدان النامية، وكذلك البلدان المتقدمة، بتقليل المخاطر والأعباء المالية الناشئة عن مثل هذه الزيادة في الأنشطة الفضائية.

33. The Legal Subcommittee was entering the second year of work to review the concept of the " launching State " and would also take up the consideration of the draft convention of the International Institute for the Unification of Private Law (UNIDROIT) on international interests in Mobile Equipment and the preliminary draft protocol thereto on matters specific to space property.
33 - وأشار إلى أن اللجنة الفرعية القانونية تستهل السنة الثانية من أعمالها المتعلقة باستعراض مفهوم " الدولة المُطْلِقة " كما أنها ستتصدى للنظر في مشروع اتفاقية المعهد الدولي لتوحيد القانون الخاص بشأن المصالح الدولية في المعدات المتنقلة والمشروع الأولي للبروتوكول الملحق بها بشأن مسائل تتعلق تحديدا بالممتلكات الفضائية.
