The mechanisms put in place to achieve the goals of the Convention involve the regulation of transboundary movement of hazardous wastes and other wastes through the prior informed consent procedures and the requirement that the management of those wastes be environmentally sound.
وتشمل الآليات التي وُضعت لتحقيق أهداف الاتفاقية تنظيم نقل النفايات الخطرة والنفايات الأخرى عبر الحدود من خلال إجراءات الموافقة المسبقة عن علم، وفرض شرط يتعلق بالإدارة السليمة بيئيا لهذه النفايات.

1. Does the agreement address the control of the transboundary movement of hazardous wastes and other wastes subject to the Basel Convention?
1 - هل يتناول الاتفاق مسألة التحكم في نقل النفايات الخطرة والنفايات الأخرى عبر الحدود الخاضعة لاتفاقية بازل؟

The objective of the Protocol is to provide for a comprehensive regime for liability and for adequate and prompt compensation for damage resulting from the transboundary movement of hazardous wastes and other wastes and their disposal including illegal traffic in those wastes.
يهدف هذا البروتوكول إلى تهيئة نظام شامل للمسؤولية وللتعويض الكافي والفوري عن الضرر الناجم عن نقل النفايات الخطرة والنفايات الأخرى والتخلص منها عبر الحدود بما في ذلك الاتجار غير المشروع في تلك النفايات

(d) Ensure that the transboundary movement of hazardous wastes and other wastes is reduced to the minimum consistent with the environmentally sound and efficient management of such wastes, and is conducted in a manner which will protect human health and the environment against the adverse effects which may result from such movement;
(د) ضمان خفض حركة النفايات الخطرة والنفايات الأخرى عبر الحدود إلى الحد الأدنى بما يتفق مع الإدارة السليمة بيئياً والفعالة لهذه النفايات، وأن تجرى الحركة بطريقة توفر الحماية للصحة البشرية والبيئة من الآثار الضارة التي قد تنجم عن هذه الحركة؛

In the Declaration, parties recognized that despite the efforts that have been made and the progress that has been achieved since the entry into force of the Basel Convention, the volume of hazardous and other wastes continues to increase at the global level, and that the transboundary movement of hazardous wastes and other wastes has not diminished.
وأقرت الأطراف، في الإعلان، بأنه على الرغم من الجهود التي بذلت والتقدم الذي أحرز منذ بدء نفاذ اتفاقية بازل لا تزال كمية النفايات الخطرة والنفايات الأخرى مستمرة في ازدياد على المستوى العالمي، كما أن نقل النفايات الخطرة والنفايات الأخرى عبر الحدود لم ينخفض.

1. The Protocol shall apply to damage due to an incident occurring during a transboundary movement of hazardous wastes and other wastes and their disposal, including illegal traffic, from the point where the wastes are loaded on the means of transport in an area under the national jurisdiction of a State of export.
1 - يسري هذا البروتوكول على الضرر الناجم عن الحوادث التي تقع أثناء نقل النفايات الخطرة والنفايات الأخرى والتخلص منها عبر الحدود، بما في ذلك الاتجار غير المشروع، من النقطة التي تم فيها تحميل النفايات على وسائط النقل داخل السلطة الوطنية لدولة التصدير.

5. The Secretariat did, however, receive general inquiries from developing countries, and from international organizations acting on behalf of developing countries, for assistance in putting in place measures to prevent accidents and damage to the environment caused by the transboundary movement of hazardous wastes and other wastes and their disposal.
5 - بيد أن الأمانة تلقت استفسارات عامة من بلدان نامية ومن منظمات دولية تعمل بالإنابة عن البلدان النامية للمساعدة في وضع تدابير لمنع وقوع الحوادث والأضرار على البيئة، الناجمة عن نقل النفايات الخطرة والنفايات الأخرى والتخلص منها عبر الحدود.

Restrictions on the Transboundary movement of hazardous wastes and other wastes (as reported by Parties in response to the 2000 questionnaire on transmission of information in accordance with article 13 of the Convention)

In developing its capacity-building and transfer of technology and in putting in place measures to prevent accidents and damage to the environment caused by the transboundary movement of hazardous wastes and other wastes and their disposal.
(ج) ومن أجل تطوير بناء القدرات ونقل التكنولوجيا لدى ذلك الطرف، واتخاذ تدابير لمنع وقوع الحوادث والأضرار التي تلحق بالبيئة من جراء نقل النفايات الخطرة والنفايات الأخرى والتخلّص منها عبر الحدود .

3 - وأقرت الأطراف، في الإعلان، بأنه على الرغم من الجهود التي بذلت والتقدم الذي أحرز منذ بدء نفاذ اتفاقية بازل لا تزال كمية النفايات الخطرة والنفايات الأخرى مستمرة في ازدياد على المستوى العالمي، كما أن نقل النفايات الخطرة والنفايات الأخرى عبر الحدود لم ينخفض.

These projects would aim at developing capacity-building and transfer of technology as well as putting in place measures to prevent accidents and damage to the environment caused by the transboundary movement of hazardous wastes and other wastes and their disposal pursuant paragraph 4 of decision V/32.
ويتمثل الهدف من هذه المشاريع في بناء القدرات ونقل التكنولوجيا ووضع وتطبيق اجراءات لمنع وقوع الحوادث والأضرار في البيئة من جراء نقل النفايات الخطرة والنفايات الأخرى والتخلص منها عبر الحدود. اعمالاً للفقرة 4 من المقرر 5/32.

(d) Ensure that the transboundary movement of hazardous wastes and other wastes is reduced to the minimum consistent with the environmentally sound and efficient management of such wastes, and is conducted in a manner which will protect human health and the environment against the adverse effects which may result from such movement;
(د) ضمان خفض نقل النفايات الخطرة والنفايات الأخرى عبر الحدود إلى الحد الأدنى بما يتفق مع الإدارة السليمة بيئياً والفعالة لهذه النفايات، وأن يجري النقل بطريقة توفر الحماية للبيئة والصحة البشرية من الآثار الضارة التي قد تنجم عن هذا النقل؛

(h) Cooperate in activities with other Parties and interested organizations, directly and through the Secretariat, including the dissemination of information on the transboundary movement of hazardous wastes and other wastes, in order to improve the environmentally sound management of such wastes and to achieve the prevention of illegal traffic.
(ح) التعاون في الأنشطة مع الأطراف الأخرى ومع سائر المنظمات المهتمة مباشرة، وعن طريق الأمانة، بما في ذلك نشر المعلومات عن نقل النفايات الخطرة والنفايات الأخرى عبر الحدود بُغية تحسين الإدارة السليمة بيئياً لهذه النفايات وإنفاذ صنع الاتجار غير المشروع.
