Draft article 5, paragraph 1, stipulates that a State may exercise diplomatic protection only in respect of a person who was a national of that State continuously from the date of injury to the date of the official presentation of the claim.

1. A State is entitled to exercise diplomatic protection in respect of a person who was a national of that State continuously from the date of injury to the date of the official presentation of the claim.
1 - يحق للدولة ممارسة الحماية الدبلوماسية فيما يتعلق بشخص كان من رعايا تلك الدولة بصورة مستمرة ابتداء من تاريخ حدوث الضرر وحتى تاريخ تقديم المطالبة رسميا.

In particular, it welcomed the recognition in article 6 (bis) of the need to take account of the negligence or the wilful act or omission of the injured State or national of that State which had contributed to the damage.
وترحـب بصفـة خاصة باعتراف الفقـرة ٢ مـن المـادة ٦ مكررا بضرورة أن يؤخذ في الاعتبار اﻹهمـال أو الفعـل القصدي أو الامتناع القصدي الصادر عـن الدولة المضرورة أو مواطن لتلك الدولة والذي ساهم في وقوع الضرر.
