Article 16 follows the non-discrimination clause by prohibiting arbitrary decisions concerning nationality issues, stating that persons concerned shall not be arbitrarily deprived of the nationality of the predecessor State, or arbitrarily denied the right to acquire the nationality of the successor State, or any right of option to which they are entitled in relation to the succession of States.
أما المادة 16 فتتبع شرط عدم التمييز بحظر اتخاذ قرارات تعسفية بشأن مسائل الجنسية، حيث تنص على أنه لا يُجرد الأشخاص المعنيون تعسفاً من جنسية الدولة السلف أو يحرمون تعسفاً من حق اكتساب جنسية الدولة الخلف أو من أي حق في الخيار، إذا كانت تلك الحقوق مخولة لهم في حالة خلافة الدول.

Persons concerned shall not be arbitrarily deprived of the nationality of the predecessor State, or arbitrarily denied the right to acquire the nationality of the successor State or any right of option, to which they are entitled in relation to the succession of States.
لا يجوز تجريد الأشخاص المعنيين تجريدا تعسفيا من جنسية الدولة السلف أو حرمانهم تعسفا من حق اكتساب جنسية الدولة الخلف أو من أي حق في الخيار، إذا كانت تلك الحقوق مخولة لهم في حالة خلافة الدول.

States concerned shall take all appropriate measures to prevent persons who, on the date of the succession of States, had the nationality of the predecessor State from becoming stateless as a result of such succession.
