وقد أعلن فيها مجلس الأمن أن العراق مسؤول بمقتضى القانون الدولي " عن أي خسارة مباشرة أو ضرر مباشر، بما في ذلك الضرر اللاحق بالبيئة واستنفاد الموارد الطبيعية، أو ضرر وقع على الحكومات الأجنبية أو رعاياها أو شركاتها نتيجة لغزوه واحتلاله غير المشروعين للكويت " .

According to paragraph 16 of Security Council resolution 687 (1991), which under article 31 of the rules for claims procedures formed part of the law applicable before the Commission, Iraq was liable under international law for any direct loss, damage or injury to foreign Governments, nationals and corporations, as a result of its unlawful invasion and occupation of Kuwait.

In paragraph 16 of resolution 687 (1991) the Security Council reaffirms that Iraq is liable under international law for any direct loss, damage, or injury to foreign Governments, nationals and corporations, as a result of Iraq's unlawful invasion and occupation of Kuwait. / Accordingly, the issue of Iraq's liability for losses falling within the Commission's jurisdiction is resolved. /
18- يؤكد مجلس الأمن من جديد، في الفقرة 16 من قراره 687 (1991)، أن العراق مسؤول بمقتضى القانون الدولي عن أي خسارة مباشرة أو ضرر مباشر، أو أي أذى مباشر يلحق بالحكومات الأجنبية أو برعاياها أو شركاتها نتيجة غزو العراق واحتلاله غير المشروعين للكويت(14) وعليه يتم حسم مسألة مسؤولية العراق عن الخسائر الواقعة ضمن اختصاص اللجنة(15).

"
