5. Expresses its grave concern at the continued use of the death penalty in the Islamic Republic of Iran in violation of the relevant provisions of the International Covenant on Civil and Political Rights and the United Nations safeguards;
٥- تعرب عن بالغ قلقها إزاء استمرار توقيع عقوبة اﻹعدام في جمهورية إيران اﻹسلامية مع ما في ذلك من انتهاكات لﻷحكام ذات الصلة الواردة في العهد الدولي الخاص بالحقوق المدنية والسياسية وضمانات اﻷمم المتحدة؛

" (c) To keep in mind the safeguards guaranteeing protection of the rights of those facing the death penalty and the guarantees set out in United Nations safeguards adopted by the Economic and Social Council;

(d) To declare a moratorium on the death penalty in the light of procedural and substantive flaws in the Afghan judicial system, bearing in mind the United Nations safeguards, guaranteeing protection of the rights of those facing the death penalty;
(د) إعلان وقف اختياري لتطبيق عقوبة الإعدام في ضوء العيوب الإجرائية والموضوعية التي اعترت النظام القضائي الأفغاني مع الأخذ بعين الاعتبار ضمانات الأمم المتحدة لحماية حقوق الأشخاص الذين يواجهون عقوبة الإعدام؛

Referring to the United Nations safeguards on the Rights of Those Facing the Death Penalty, the author observes that a capital conviction must be " based upon clear and convincing evidence leaving no room for an alternative explanation of the facts " .
ويلاحظ صاحب البلاغ، في معرض إشارته إلى ضمانات الأمم المتحدة بشأن حقوق الذين يواجهون عقوبة الإعدام، أنه يجب أن تكون أي إدانة يترتب عليها حكم بالإعدام " مبنية على أدلة واضحة ومقنعة لا تفسح المجال أمام أي تفسير بديل للوقائع " .

" (n) To ensure that capital punishment will not be imposed for crimes other than the most serious and will not be pronounced in disregard of the obligations assumed under the International Covenant on Civil and Political Rights, the Convention on the Rights of the Child and the provisions of United Nations safeguards;
" (ن) ضمان عدم توقيع عقوبة الإعدام إلا على أشد الجرائم خطورة وضمان عدم إصدار الحكم بالإعدام دون مراعاة الالتزامات المعقودة بموجب العهد الدولي الخاص بالحقوق المدنية والسياسية واتفاقية حقوق الطفل وأحكام ضمانات الأمم المتحدة؛

(n) To ensure that capital punishment will not be imposed for crimes other than the most serious and will not be pronounced in disregard of the obligations assumed under the International Covenant on Civil and Political Rights, the Convention on the Rights of the Child and the provisions of United Nations safeguards;
(ن) ضمان عدم توقيع عقوبة الإعدام إلا على أشد الجرائم خطورة وضمان عدم إصدار الحكم بالإعدام دون مراعاة الالتزامات المعقودة بموجب العهد الدولي الخاص بالحقوق المدنية والسياسية واتفاقية حقوق الطفل، وأحكام ضمانات الأمم المتحدة؛

(b) To end all summary and arbitrary executions and the imposition of the death penalty for crimes committed by persons under the age of eighteen years, and to ensure that capital punishment will not be imposed for crimes other than the most serious and will not be pronounced in disregard of the obligations it has assumed under the International Covenant on Civil and Political Rights and the provisions of United Nations safeguards;
(ب) أن توقف جميع حالات الإعدام بإجراءات موجزة، والإعدام التعسفي، وأن تكفل عدم توقيع عقوبة الإعدام إلا على أشد الجرائم خطورة وعدم إصدار الحكم بالإعدام دون مراعاة الالتزامات التي تعهدت بها بموجب العهد الدولي الخاص بالحقوق المدنية والسياسية والأحكام التي نصت عليها ضمانات الأمم المتحدة؛

(n) To ensure that capital punishment will not be imposed for crimes other than the most serious and will not be pronounced in disregard of the obligations assumed under the International Covenant on Civil and Political Rights, the Convention on the Rights of the Child and the provisions of United Nations safeguards;

It submitted in evidence of this a comprehensive discussion of the procedural safeguards required for the imposition of capital punishment under American law published by the Georgetown University Law School in 1999. As regards the United Nations safeguards in general, the United States declared:
واثباتا لذلك، قدم عرض لمناقشة شاملة للضمانات الإجرائية المطلوبة لفرض عقوبة الإعدام بمقتضى القانون الأمريكي، كانت قد نشرته مدرسة القانون بجامعة جورج تاون في 1999.(38) وفيما يتعلق بضمانات الأمم المتحدة بوجه عام، أعلنت الولايات المتحدة مايلي:

" 6. Expresses its grave concern at the significant toughening of criminal legislation and its application in Iran and in particular at the incidence of capital punishment imposed for non-violent crimes, in particular cases of apostasy, in violation of the relevant provisions of the International Covenant on Civil and Political Rights and the United Nations safeguards;
" ٦ - تعرب عن بالغ قلقها إزاء التشديد الملموس للتشريعات الجنائية وتطبيقها في إيران، وبخاصة إزاء فرض عقوبة اﻹعدام على غير جرائم العنف، وعلى وجه التحديد حالات الردة، انتهاكا لﻷحكام ذات الصلة المنصوص عليها في العهد الدولي الخاص بالحقوق المدنية والسياسية وضمانات اﻷمم المتحدة؛
