3. The fact that any of the acts referred to in articles 2 to 4 of the present Statute was committed by a subordinate does not relieve his or her superior of criminal responsibility if he or she knew or had reason to know that the subordinate was about to commit such acts or had done so and the superior failed to take the necessary and reasonable measures to prevent such acts or to punish the perpetrators thereof.

The recent jurisprudence of the International Criminal Tribunals has reaffirmed the three elements necessary for superior criminal responsibility to arise: (i) the existence of a superior-subordinate relationship; (ii) the superior knows or has reason to know that the criminal act is about to be or has been committed; and (iii) the superior fails to take necessary and reasonable measures to prevent the criminal act or to punish the perpetrator.
28- ولقد أكدت مجدداً الاجتهادات القضائية الأخيرة للمحكمتين الجنائيتين الدوليتين العناصر الثلاثة الضرورية لنشوء مسؤولية جنائية تترتب على السلطة العليا وهي: `1` وجود علاقة رئيس - مرؤوس؛ و`2` أن يعلم الرئيس أو يتوفر لديه السبب لمعرفة أن الفعل الإجرامي على وشك أن يحدث أو أنه حدث فعلاً؛ و`3` أن الرئيس لم يتخذ التدابير الضرورية والمعقولة للحؤول دون ارتكــاب الجاني للعمل الإجرامي أو معاقبته(22).

100. A number of military commanders and civilian superiors may reasonably be suspected of responsibility for crimes against humanity because of their knowing failure to take all necessary and reasonable measures within their power to prevent or repress the commission of relevant crimes by their subordinates or to submit the matter to the competent authorities.
