The Zambian Constitution made no reference to Covenant rights that were non-derogable in the event of a state of emergency, in violation of article 4 of the Covenant.
88- ثم قال إنه لم ترد أي إشارة في الدستور الزامبي إلى الحقوق التي يكفلها العهد والتي لا يجوز تقييدها في حالة إعلان حالة الطوارئ وهو ما يمثل انتهاكاً للمادة 4 من العهد.

20- أخذت اللجنة المعنية بحقوق الإنسان علماً بالشرح المقدم من بليز ومفاده أنه لما كانت الأحكام المتعلقة بالحق في الحياة، وخطر التعذيب، وحرية الفكر والوجدان والدين، غير مُدرجة في الفقرة 10 من المادة 18 من الدستور بوصفها يجوز تقييدها في حالات الطوارئ فإنه يترتب على ذلك أن هذه الحقوق لا يجوز تقييدها في ظل حالة الطوارئ.
