ولم تستعن الدولة الطرف برأي الخبراء في أسباب وعمر الجروح التي تظهر على صدر صاحب البلاغ واستندت في قرارها رفض طلب اللجوء المقدم من صاحب البلاغ فقط إلى تناقضات لا تعتبر محورية في الادعاء العام الذي يواجهه صاحب البلاغ باعتباره من جماعة التاميل الإثنية في شمال سري لانكا.

7.3 The Committee notes the author's claim that as an ethnic Tamil from the North of Sri Lanka, who has in the past been detained on several occasions and tortured by the Sri Lankan army, as evidenced by the scars he retained on his chest, he faces a real risk of being subjected to treatment contrary to article 7 of the Covenant if returned.
7-3 وتلاحظ اللجنة ادعاء صاحب البلاغ من أنه باعتباره من جماعة التاميل الإثنية من شمال سري لانكا تعرض في الماضي للاحتجاز والتعذيب على يد قوات الجيش في سري لانكا، كما تشهد بذلك الجروح التي لا تزال على صدره، فإنه يواجه خطراً حقيقياً يتمثل في التعرض لمعاملة تتعارض مع المادة 7 من العهد في حال إعادته.

A recent press report on fighting in the North of Sri Lanka noted that “young boys barely in their teens are blindfolded and escorted by a woman Tiger cadre to the battlefield, in groups of eight to 10, their blindfolds removed and they are ordered to fire at troops”.
وقد وصف تقرير صحافي نشر مؤخرا عن القتال في شمال سري لانكا كيف أن " أطفالا لم يتجاوزوا سن المراهقة بعد كانت تصطحبهم إمرأة من كوادر نمور التاميل، وهم معصوبو اﻷعين، إلى ساحة المعركة، في مجموعات تتكون من ثمانية إلى عشر أفراد، ثم تزال العصابة عن أعينهم ويؤمرون بإطلاق النار على القوات المسلحة " .
