14.2 As to whether the author's extradition to Kyrgyzstan exposed him to a real risk of torture or ill-treatment, the Committee observes that States parties must not expose individuals to the danger of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement.

A reference was also made to general comment No. 20 (1992) of the Human Rights Committee, according to which States parties to the International Covenant on Civil and Political Rights " must not expose individuals to the danger of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement " .

7.8 With regard to article 7 of the Covenant, the Committee recalls that States parties must not expose individuals to the risk of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by virtue of their extradition, expulsion or refoulement.

In its interpretation of this provision, the Human Rights Committee (HRC) has opined that " States parties must not expose individuals to the danger of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement " .

In the same vein, the Human Rights Committee considered the link between removal, expulsion or refoulement and torture in its General Comment No. 20: " States parties must not expose individuals to the danger of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement " .
