وخلصت اللجنة الى أن في طرد مقدم البلاغ الى باكستان، في ظل الظروف الخاصة بحالة مقدم البلاغ، انتهاكا لالتزام كندا، بموجب المادة ٣ من الاتفاقية، بعدم طرد أو إعادة شخص الى دولة ثالثة حيث تتوافر أسباب حقيقية تدعو للاعتقاد بأنه سيكون في خطر التعرض للتعذيب.

9.1 The Committee must determine whether the expulsion of the complainant to Spain violated the State party's obligation under article 3, paragraph 1, of the Convention not to expel or return ( " refouler " ) an individual to another State where there are substantial grounds for believing that he or she would be in danger of being subjected to torture.

4.1 In a letter of 19 August 1998, the State party informed the Committee that it had been unable to accede to the Committee’s invitation of 23 June 1998, pursuant to article 108, paragraph 9, of its rules of procedure, not to expel or return the author to Turkey since he and his family had been missing since 15 September 1996.
