Bearing in mind the obligations of States under international law, as applicable, to exercise due diligence to prevent crimes against migrants, to investigate and punish perpetrators and, in accordance with applicable law, to rescue victims and to provide for their protection, and that not doing so violates and impairs or nullifies the enjoyment of the human rights and fundamental freedoms of victims,

74. In spite of the heinous crimes that characterize terrorist action, Member States are urged to ensure that any measures taken to combat terrorism are consistent with the obligations of States under international law.

10. One of the measures that individual States could take to enhance respect for international law would be to recognize in their national legal systems the principle of the primacy of international law over national law and the obligation of all organs of the State to ensure, within the limits of their competence, that national law was consistent with the obligations of States under international law.
