27- إلا أن فعالية إجراءات التوفيق أو الوساطة أو المساعي الحميدة ينبغي ألا تقارن بفعالية التسوية الإلزامية للمنازعات بل بالحالة التي تسود إذا لم تكن هناك أية إجراءات متاحة على الإطلاق لحل المنازعات في هذا المجال.
