One of the fundamentals of the right to due process for everyone charged with a criminal offence is to “examine, or have examined, the witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him”. (Covenant on Civil and Political Rights, art. 14,3 (e)).
إن أحد العناصر اﻷساسية للحق في إجراءات مناسبة ﻷي شخص يتهم بجريمة هو حقه في " أن يناقش شهود الاتهام، بنفسه أو من قبل غيره، وأن يحصل على الموافقة على استدعاء شهود النفي بذات الشروط المطبقة في حالة شهود الاتهام " )المادة ٤١، ٣)ﻫ( من العهد الدولي الخاص بالحقوق المدنية والسياسية(.

12. Subparagraph 3 (e) states that the accused shall be entitled to examine or have examined the witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him.
٢١- وتنص الفقرة الفرعية ٣)ﻫ( على انه يحق للمتهم أن يناقش شهود الاتهام بنفسه أو من قبل غيره، وأن يحصل على الموافقة على استدعاء شهود النفي واستجوابهم بذات الشروط المطبقة في حالة شهود الاتهام.

" (e) To examine, or have examined, the witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him;
" )ﻫ( أن يناقش شهود الاتهام، بنفسه أو من قبل غيره، وأن يحصل على الموافقة على استدعاء شهود النفي بذات الشروط المطبقة في حالة شهود الاتهام؛

1. The accused shall be entitled to examine or have examined [the prosecution witnesses] [witnesses against him/her] and to obtain the attendance and examination of witnesses [for the defence] [on his behalf] under the same conditions as witnesses [for the prosecution] [against him/her]. [In addition the accused shall also be entitled to present any other evidence.]
١ - يحق للمتهم أن يناقش ]شهود اﻹثبات[ ]الشهود الذين يدلون بالشهادة ضده[ أو أن تتم مناقشتهم من قبل غيره، وأن يؤمن له حضور وسماع ]الـ[شهود ]النفي[ ]الذين يدلون بالشهادة لمصلحته[ بنفس شروط ]شهود اﻹثبات[ ]الشهود الذين يدلون بالشهادة ضده[. ]وإضافة إلى ذلك، يحق للمتهم أن يدلي بأي أدلة أخرى[

(e) To examine, or have examined, the witnesses against him or her and to obtain the attendance and examination of witnesses on his or her behalf under the same conditions as witnesses against him or her;

12. Subparagraph 3 (e) states that the accused shall be entitled to examine or have examined the witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him.
12- وتنص الفقرة الفرعية 3(ه) على انه يحق للمتهم أن يناقش شهود الاتهام بنفسه أو من قبل غيره، وأن يحصل على الموافقة على استدعاء شهود النفي واستجوابهم بذات الشروط المطبقة في حالة شهود الاتهام.

(c) The accused has the right to examine, or to have examined, the witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him.
(ج) للمتهم الحق في أن يناقش شهود الاتهام، بنفسه أو من قبل غيره، وأن يحصل على الموافقة على استدعاء شهود النفي بذات الشروط المطبقة في حالة شهود الاتهام.

3.9 The author claims that the prosecution's inability to ensure the appearance of Mr. A.R. in court, despite his and his lawyer's numerous requests resulted in a violation of his right to examine the witnesses against him and to obtain the attendance and examination of witnesses on his behalf, guaranteed under article 14, paragraph 3(e), of the Covenant.
3-9 ويدعي صاحب البلاغ أن عجز الادعاء عن إحضار السيد أ. ر. أمام المحكمة، رغم طلباته وطلبات محاميه المتعددة، أسفر عن انتهاك لحقه في أن يناقش شهود الإثبات وأن يحصل على الموافقة لإحضار شهود النفي، المضمون بموجب الفقرة 3(ه( من المادة 14 من العهد.

In particular, article 14, paragraph 3 (e), stipulates that everyone charged with a criminal offence shall be entitled " to examine, or have examined, the witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him " .
وعلى وجه التحديد، تنص الفقرة 3 من المادة 14 على أن لكل متهم بجريمة الحق في " أن يناقش شهود الاتهام، بنفسه أو من قبل غيره، وأن يحصل على الموافقة على استدعاء شهود النفي بذات الشروط المطبقة في حالة شهود الاتهام " .
