The Special Rapporteur was informed that many people were arrested at HADEP offices throughout the country following the demonstrations for independent monitoring of Abdullah Ocalan's trial.

440. On 30 June the Special Rapporteur transmitted her concern to the Government regarding the death sentence imposed upon Abdullah Ocalan.
440- وفي 30 حزيران/يونيه نقلت المقررة الخاصة قلقها إلى الحكومة بشأن حكم بالإعدام فرض على عبد الله أوجلان.

She was informed that during his pre-trial detention Mr. Ocalan was held incommunicado for 10 days, and that his access to legal counsel had been severely limited.
وتم إبلاغها بأن السيد أوجلان وضع في الحبس الانفرادي لمدة عشرة أيام خلال فترة احتجازه السابقة على المحاكمة وأن قيوداً شديدة فرضت على سبيل وصوله إلى محام.

By letter dated 9 March the Government transmitted to the Special Rapporteur a Fact Sheet regarding the arrest of Abdullah Ocalan.

456. The Special Rapporteur is grateful to the Government of Turkey for its numerous replies to her communications, especially those concerning the case of Abdulah Ocalan.

On 15 October the Special Rapporteur transmitted an urgent appeal after being informed that Mr. Ocalan's death sentence had been confirmed.
وفي 15 تشرين الأول/أكتوبر أحالت المقررة الخاصة نداء عاجلاً بعد أن أبلغت بأن حكم الإعدام الصادر بحق السيد أوجلان قد تم إقراره.

On 22 March the Government also transmitted the following information concerning the case of Mr. Ocalan: " Abdullah Ocalan is under daily medical surveillance and he has been able to have access to his legal counsels.
وفي 22 آذار/مارس أحالت الحكومة أيضاً المعلومات التالية المتعلقة بقضية السيد أوجلان: " يخضع عبد الله أوجلان لمراقبة طبية يومية وقد أمكنه الاتصال بمحاميه.

Upon the request made by 16 lawyers to the Office of the Chief Public Prosecutor of the Istanbul State Security Court to have a meeting with the accused detainee Abdullah Ocalan as his defence counsels, the matter was brought to the knowledge of the Public Prosecutor of the island of Imrali where Ocalan is being detained and accordingly permission was granted to lawyer Mr. Osman Baydemir.
وبناء على طلب تقدم به 16 محامياً إلى مكتب النائب العام الأول في محكمة أمن الدولة باسطنبول بإجراء لقاء مع عبد الله أوجلان على أساس أنهم محاموه، عرض الأمر على النائب العام في جزيرة إمرالي، أين يحتجز حالياً أوجلان وصدر تبعاً لذلك الإذن لمحاميه السيد عثمان بيدنير.

On 08 March 1999, Mr. Ahmet Zeki Okçouglu and his brother, lawyer Selim Okçouglu, lawyer Mr. Niyazi Bulgan and lawyer Mr. Niyazi Bulgan, were given a " Power of attorney " by Abdullah Ocalan.
وفي 8 آذار/مارس 1999 قام عبد الله أوجلان بتوكيل السيد أحمد ذكي أوكرلو وأخيه المحامي سليم أوكرلو والمحامي السيد نيازي بلغان.

Lawyers Selim Okçouglu, Niyazi Bulgan and Niyazi Bulgan visited Ocalan on 16 March 1999 and stayed for 4 hours.
وزار المحامون السيد أحمد ذكي أوكرلو والسيد سليم أوكرلو والسيد نيازي بلغان أوجلان يوم 16 آذار/مارس 1999 وبقوا هناك لمدة أربع ساعات.

443. By letter dated 1 July the Government transmitted to the Special Rapporteur information concerning the verdict in the case of Abdullah Ocalan.
443- وبموجب رسالة مؤرخة 1 تموز/يوليه أحالت الحكومة إلى المقررة الخاصة معلومات تتعلق بالحكم الصادر في قضية عبد الله أوجلان.

In Mardin, 161 persons were taken into custody in the aftermath of the arrest of Abdullah Ocalan, during the demonstrations in favour of the PKK in that province. Fiftyseven of these people were immediately released by the DirectorateGeneral of Mardin and another 93 were subsequently released by the court.
وفي نوردين اعتقل 161 شخصاً في أعقاب عملية اعتقال عبد الله أوجلان أثناء المظاهرات التي نظمت تأييداً لحزب العمل الكردستاني في تلك المنطقة وعمدت المديرية العامة في نوردين إلى إطلاق سراح 57 من هؤلاء فوراً وأطلق سراح 93 شخصاً آخر من قبل المحاكم.

453. Irfan Dundar, Mükrime Tepe, Niyazi Bulgan and Derya Bakir, defence counsels who later came to the court, without asking for security measures, entered the room, sat down next to the victims' families and declared their willingness to " defend Abdullah Ocalan " which led to an upheaval among the spectators.
453- ثم أن عرفان دوندار وموكريم تيبي ونيازي بولغان وديريا باكير وهم محامو الدفاع الذين وصلوا في وقت لاحق إلى المحكمة ودخلوا القاعة دون طلب تدابير أمنية وجلسوا بجانب أسر الضحايا وأعلنوا عن استعدادهم " للدفاع عن عبد الله أوجلان " وهذا أثار ضجة بين الحاضرين.

The Special Rapporteur further sent one joint appeal with the Special Rapporteur on the independence of judges and lawyers and another with the Special Rapporteur on the question of torture to the Government of Turkey expressing concern over the security of the lawyers representing Abdulah Ocalan.
وأرسلت المقررة الخاصة كذلك نداء بالاشتراك مع المقرر الخاص المعني باستقلال القضاة والمحامين، كما أرسلت نداءً آخر بالاشتراك مع المقرر الخاص المعني بمسألة التعذيب إلى حكومة تركيا إعراباً عن القلق إزاء أمن المحامين الذين يمثلون عبد الله أوجلان.

In Ocalan v. Turkey (2005), the European Court held that the fear and uncertainty about the future generated by a death sentence, when a real possibility existed that the sentence would be enforced, inevitably caused strong human anguish.
وفي قضية أوكالان ضد تركيا (2005)، اعتبرت المحكمة الأوروبية أن ما يولده الحكم بالإعدام من خوف وتخوف من المستقبل عندما تكون هناك إمكانية تنفيذ الحكم، يحدث بالضرورة شعورا قويا بالكرب لدى الإنسان(46).
