49. The view was expressed that article 27 was problematic because it stated that the invocation of a circumstance precluding wrongfulness was " without prejudice to the question of compensation for any material harm or loss caused by the act in question " , although it should not be applicable to certain circumstances precluding wrongfulness such as consent, compliance with peremptory norms, self-defence, countermeasures and force majeure.
