82. The Government of Israel should rescind all policies and practices that directly or indirectly lead to the forced eviction and/or forcible transfer of civilians, including demolitions and/or confiscations, or plans for demolitions or confiscations, and those that contribute to the creation of a coercive environment that forces Palestinians to leave their homes or land.
82 - وينبغي لحكومة إسرائيل إلغاء جميع السياسات والممارسات التي تؤدي بشكل مباشر أو غير مباشر إلى الإخلاء القسري و/أو النقل القسري للمدنيين، بما في ذلك الهدم و/أو المصادرة، أو خطط الهدم أو المصادرة، والسياسات والممارسات التي تساهم في تهيئة بيئة قسرية ترغم الفلسطينيين على مغادرة منازلهم أو أراضيهم.

(a) Consent cannot be inferred by reason of any words or conduct of a victim where force, threat of force, coercion or taking an advantage of a coercive environment undermined the victim's ability to give voluntary and genuine consent.
(أ) لا يمكن استنتاج وجود الرضا من أي كلمات أو سلوك للمجني عليه حيثما تكون إرادته بإعطاء الموافقة الطوعية والفعلية قد تقوضت بفعل استخدام القوة أو التهديد باستخدام القوة أو استغلال بيئة قسرية.

3. The invasion was committed by force, or by threat of force or coercion, such as that caused by fear of violence, duress, detention, psychological oppression or abuse of power, against such person or another person, or by taking advantage of a coercive environment, or the invasion was committed against a person incapable of giving genuine consent.
٣ - أن يُرتكَب الاعتداء بالقوة أو بالتهديد باستخدام القوة أو اﻹكراه، كأن ينشأ عن خوف الشخص المعني أو شخص آخر من التعرض ﻷعمال عنف أو حبس أو اعتقال أو إيذاء نفسي أو معاملة سيئة، أو كان ينشأ عن استغلال بيئة قسرية أو أن يُرتكَب الاعتداء على شخص لا يستطيع أن يعبﱢر حقيقة عن رضاه)٢(.

In short, rape is any physical invasion of a sexual nature perpetrated without the consent of the victim, that is by force or coercion, such as that caused by fear of violence, duress, detention or by taking advantage of a coercive environment.
والاغتصاب بإيجاز هو أي تعد جسمي ذي طبيعة جنسية يرتكب بدون رضى المجني عليه، أي باستعمال القوة أو الإكراه، مثل الذي يحدث نتيجة الخوف من العنف أو الإرغام أو الحبس أو استغلال ظروف قسرية().

(i) Any force, threat of force, coercion or taking an advantage of a coercive environment did not affect adversely the victim's ability to consent; and

359. In addition to rape, international law also prohibits and criminalizes, as either a war crime or a crime against humanity, any serious act of gender violence causing the victim to engage in an act of sexual nature by force, or by threat of force or coercion against the victim or another person, or by taking advantage of a coercive environment.
