124. The term " alien " cannot be defined in itself but only what it is not, that is, a national or a person who holds the nationality of a given State or who is a ressortissant of that State. Accordingly, an alien is a person who is under the jurisdiction of another nation or State, a person who does not hold the nationality of the forum State.
