38. In addition to allowing listed individuals to return to their State of nationality, the travel ban permits an exemption without the need for Committee agreement " where entry or transit is necessary for the fulfilment of a judicial process " .

It instructs States to prevent the entry into or transit through their territories of listed individuals except where their nationals are concerned, or for the fulfilment of a judicial process, or with the Committee's agreement, including where this travel directly relates to supporting efforts by the Government of Afghanistan to promote reconciliation (para. 1 (b)).

The Security Council, in resolution 1822 (2008), paragraph 1 (b), and the Committee in its guidance notes, have made clear that no exemption is necessary where a State decides to allow one of its nationals entry, or where entry or transit is necessary for the fulfilment of a judicial process.

70. When States do refuse entry or transit to an individual on the basis of a listing, or when a listed individual changes location as a result of the permitted exceptions to the travel ban, such as return to the State of nationality or movement in support of a judicial process, it would be useful for the Committee to know, so that it may update the List and record any new information that comes to light.

15. Three types of exemptions to the travel ban are set out in paragraph 31 of resolution 2134 (2014), as follows: for humanitarian need, including religious obligation (para. 31 (a)); for entry or transit necessary for the fulfilment of a judicial process (para. 31 (b)); and for the furtherance of the objectives of peace and national reconciliation in the Central African Republic and stability in the region (para. 31 (c)).

41. At the Eleventh Meeting of the States Parties, Greece indicated that the EAS proposal remained unexecuted pending the completion of a judicial process and budgetary appropriations which were anticipated to come following the adoption of the 2012 budget by the Parliament.
