" (2) After the establishment of a registration system as provided in article 1 of the annex to this Convention, conflicts of priority referred to in paragraph (1) of this article will be governed by paragraph (4) of this article.

It was noted that, after the Working Group's decision to turn the annex into an optional part of the draft Convention (see para. 27 above), there was no need to provide for a conference for the establishment of a registration system.

In general, the Committee expresses concern at the statement by the delegation from the State party that there are problems with the nationwide implementation of Decision No. 176/2010 of the Office of the National Police Commander, ordering the introduction of a registration system in police stations (arts. 2, 11 and 12).
وإجمالاً، تعرب اللجنة عن قلقها مما ذكره وفد الدولة الطرف من وجود صعوبات أمام تنفيذ القرار رقم 176/2010 الصادر عن قيادة الشرطة الوطنية الذي يأمر بإنشاء نظام للتسجيل في مخافر الشرطة على الصعيد الوطني (المواد 2 و11 و12).

(b) The priority rules set forth in section I of the annex and will effectuate such rules by use of a registration system that fulfils the purposes of such rules, in which case, for the purposes of section I of the annex, registration pursuant to such a system has the same effect as registration pursuant to section II of the annex;
(ب) قواعد الأولوية الواردة في الباب الأول من المرفق، وأنها ستنفذ تلك القواعد باستخدام نظام للتسجيل يفي بأغراض تلك القواعد، وفي هذه الحالة، ولأغراض الباب الأول من المرفق، يكون للتسجيل بمقتضى هذا النظام المفعول ذاته كالتسجيل بمقتضى الباب الثاني من المرفق؛ أو

(b) The priority rules set forth in section I of the annex and will effectuate such rules by use of a registration system that fulfils the purposes of such rules, in which case, for the purposes of section I of the annex, registration pursuant to such a system has the same effect as registration pursuant to section II of the annex;

“(1) Until the establishment of a registration system as provided in article 1 of the annex to this Convention, priority among several assignees of the same receivables from the same assignor [is determined on the basis of the time of the assignment] [will be governed by the law determined in accordance with paragraph (1) of article 28].
" )١( لحين انشاء نظام للتسجيل وفقا لما هو منصوص عليه في المادة ١ من مرفق هذه الاتفاقية ، فان اﻷولوية فيما بين عدد من الذين أحيلت اليهم نفس المستحقات من نفس المحيل ]تحدد على أساس وقت الاحالة[ ]تخضع للقانون المحدد وفقا للفقرة )١( من المادة ٨٢[ .

“(2) After the establishment of a registration system as provided in article 1 of the annex to this Convention, priority among several assignees of the same receivables from the same assignor will be governed by paragraphs (3) and (4) of this article.
" )٢( بعد انشاء ، نظام للتسجيل وفقا لما هو منصوص عليه في المادة ١ من مرفق هذه الاتفاقية ، فان اﻷولوية فيما بين عدد من الذين أحيلت اليهم نفس المستحقات من نفس المحيل تخضع للفقرتين )٣( و )٤( من هذه المادة .

" (1) Until the establishment of a registration system as provided in article 1 of the annex to this Convention, priority between an assignee and the insolvency administrator or the assignor's creditors will be governed by [paragraph (3) of this article] [the law determined in accordance with paragraphs (2) and (3) of article 28].
" )١( لحين انشاء نظام للتسجيل حسبما هو منصوص عليه في المادة ١ من مرفق هذه الاتفاقية ، فان اﻷولوية بين المحال اليه ومدير الاعسار أو دائني المحيل سوف تخضع ]للفقرة )٣( من هذه المادة[ ]للقانون المحدد وفقا للفقرتين )٢( و )٣( من المادة ٨٢[ .

At the close of the discussion, the Working Group was reminded of the fact that paragraph (1) was intended to operate, “until the establishment of a registration system”, as an “interim” priority rule, and, after the establishment of a registration system, as an alternative priority rule for those States that would not wish to be bound by the registration provisions of the draft Convention.
٦٢ - وفي ختام المناقشة ، جرى تذكير الفريق العامل بأن المقصود من الفقرة )١( هو العمل بها " لحين انشاء نظام للتسجيل " ، باعتبارها قاعدة " مؤقتة " بشأن اﻷولوية ، والعمل بها بعد انشاء نظام للتسجيل باعتبارها قاعدة بديلة بشأن اﻷولوية للدول التي لن ترغب في التقيد بأحكام التسجيل الواردة في مشروع الاتفاقية .
