I cannot subscribe to the Committee's finding of a violation of article 26 of the Covenant, for the following reasons:
ليس بوسعي الموافقة على ما قررته اللجنة من حدوث انتهاك للمادة 26 من العهد، وذلك للأسباب التالية:

In relation to admissibility, it submits that the complainant has failed to establish a prima facie case of a violation of article 3.
وفيما يتعلق بالمقبولية، تدفع بأن صاحب الشكوى لم يتمكن من إقامة دعوى ظاهرة الصحة بحدوث انتهاك للمادة 3.

3.10 With regard to the allegation of a violation of article 12 of the Covenant, the authors cannot travel freely or leave Belgium.
3-10 وفيما يتعلق بادعاء الإخلال بأحكام المادة 12 من العهد، لا يمكن لصاحبي البلاغ السفر بحرية أو مغادرة بلجيكا.

Consequently, the Committee finds that the authors, as Afrikaans speakers, are victims of a violation of article 26 of the Covenant.

6.3 Concerning the author's claim of a violation of article 7, the Committee notes that after the Office of the Procurator General refused to open a criminal case and to investigate the allegations of torture against the policemen allegedly involved in his arrest, the author did not appeal to court the above refusal to investigate his claim.
6-3 وفي ما يتعلق بادعاء صاحب البلاغ حدوث انتهاك لأحكام المادة 7، تلاحظ اللجنة أنه بعد رفض مكتب المدعي العام إجراء تحقيق جنائي في مزاعم التعذيب والتحقيق مع رجال الشرطة الذين يُزعَم أنهم اشتركوا في عملية إلقاء القبض على صاحب البلاغ، فإن هذا الأخير لم يطعن أمام المحكمة في هذا الرفض للتحقيق في ادعائه.

11.9 In the light of the above finding of a violation of article 6 of the Covenant, the Committee will not examine separately the authors' allegation under article 7 with regard to Mr. Kovalev's mental distress caused by the situation of uncertainty about his fate (see para. 3.10 above).
11-9 وفي ضوء الاستنتاج أعلاه وأن هناك انتهاكاً للمادة 6 من العهد، سوف لن تنظر اللجنة على حدة في ادعاء صاحبتي البلاغ في إطار المادة 7 فيما يتعلق بالكرب الذهني الذي عانى منه السيد كوفاليف نتيجة لحالة الشك المحيطة بمصيره (انظر الفقرة 3-10 أعلاه).

3.2 In support of their contention of a violation of article 27, the authors refer to the Views adopted by the Committee in the cases of Ivan Kitok (No. 197/1985) and B. Ominayak and members of the Lubicon Lake Band v. Canada (No. 167/1984), as well as to ILO Convention No.169 concerning the rights of indigenous and tribal people in independent countries.
٣-٢ وإثباتاً لمزاعمهم المتعلقة بحدوث انتهاك ﻷحكام المادة ٧٢ من العهد، يشير مقدمو البلاغ إلى اﻵراء التي اعتمدتها اللجنة في قضية إيفان كيتوك )رقم ٧٩١/٥٨٩١( وقضية ب. أوميناياك وأعضاء جماعة بحيرة لوبيكون ضد كندا )رقم ٧٦١/٤٨٩١(، وكذلك إلى اتفاقية منظمة العمل الدولية رقم ٩٦١ بشأن حقوق الشعوب اﻷصلية والقبلية في البلدان المستقلة.

However, according to the State party the question whether or not the detention was lawful is irrelevant for the determination of a violation of article 10 of the Covenant, which deals with humane treatment during (lawful or unlawful) detention.
