The Committee recommends that high priority be given to the eradication of discriminatory practices and racial prejudices in Ghana, through the strengthening of education in general and of human rights education programmes in particular, the criminalization of acts of racial discrimination and effective punishment.

426. With respect to article 6 of the Convention, there is concern at the lack of legislative provisions to implement the right to just and adequate reparation or satisfaction for any damage suffered as a result of acts of racial discrimination.
٤٢٦ - وفيما يتعلق بالمادة ٦ من الاتفاقية هناك شعور بالقلق لعدم وجود اﻷحكام التشريعية اللازمة ﻹعمال الحق في جبر عادل ومناسب أو ترضية عادلة مناسبة ﻷي ضرر يلحق باﻹنسان نتيجة ﻷي عمل من أعمال التمييز العنصري.

128. The Committee recommends that the next report contain detailed information regarding allegations and prosecutions in the case of acts of racial discrimination.
١٢٨ - وتوصي اللجنة بتضمين التقرير التالي معلومات مفصلة عن الادعاءات واﻹجراءات القانونية في حالة ارتكاب أعمال التمييز العنصري.

311. The Committee recommends that the next periodic report of Brazil contain detailed information on complaints filed by the victims of acts of racial discrimination and on how they were dealt with by the courts.
١١٣ - وتوصي اللجنة بأن يتضمن التقرير الدوري التالي للبرازيل معلومات مفصلة عن الشكاوى التي قدمها ضحايا أعمال التمييز العنصري وعن الطريقة التي تعاملت بها المحاكم مع هذه الشكاوى.

12. The Committee observes that articles 246 and 292 of the Criminal Code and article 4 of the Government Ethics Act cover only certain types of acts of racial discrimination when committed by public officials or in the workplace.
12- تلاحظ اللجنة أن المادتين 246 و292 من القانون الجنائي، والمادة 4 من قانون مدونة السلوك في الوظائف العامة، تكتفي بالإشارة إلى بعض أفعال التمييز العنصري التي يرتكبها موظفون عامون أو التي تُرتكب في مجال العمل.

Lastly, the State party should amend article 202 bis of the Criminal Code to ensure the investigation of acts of racial discrimination, the prosecution and punishment of the perpetrators, and adequate compensation for the victims so that it is not necessary to establish that those acts impede or hinder the exercise of one or more rights in order to constitute an offence.
وأخيراً، ينبغي للدولة الطرف أن تعدّل المادة 202 مكرراً من القانون الجنائي لتكفلَ التحقيق في أفعال التمييز العنصري ومحاكمة مرتكبيها ومعاقبتهم وتقديم تعويضات مناسبة للضحايا، بحيث لا يُقتضى أن ينص تعريف هذه الأفعال الجنائي على أنها قد " حالت دون " ممارسة حق أو أكثر أو " عرقلته " .

Taking note of article 369 of the draft criminal code, which punishes acts of racial discrimination, the Committee wishes to receive information on complaints of acts of racial discrimination and on the relevant legal action taken by the victims or on their behalf.
378- ومع الإحاطة علماً بالمادة 369 من مشروع القانون الجنائي التي تقضي بفرض عقوبات على أفعال التمييز العنصري، تود اللجنة الحصول على معلومات عن الشكاوى المتعلقة بأفعال التمييز العنصري والإجراءات القانونية ذات الصلة التي اتخذها الضحايا أو من ينوب عنهم.

18- وتعرب اللجنة عن قلقها إزاء الانعدام التام تقريباً للشكاوى المتعلقة بأفعال التمييز العنصري التي ترفع إلى المحاكم وغيرها من الهيئات المختصة أثناء الفترة المشمولة بالتقرير، في الوقت الذي توجد فيه نسبة كبيرة من الأشخاص الذين يُدعى أنهم يتعرضون للتمييز في حياتهم اليومية على أساس خلفيتهم الإثنية.

Recalling its general recommendation No. 31 (2005) on the prevention of racial discrimination in the administration and functioning of the criminal justice system, the Committee also recommends that the State party include in its next report information on the number and nature of acts of racial discrimination and prosecutions, convictions and sentences of their perpetrators.
وإذ تذكّر اللجنة بتعليقها العام رقم 31(2005) بشأن منع التمييز العنصري في إدارة شؤون نظام القضاء الجنائي وسيره، توصي اللجنة الدولة الطرف أيضاً بتضمين تقريرها الدوري المقبل معلومات عن عدد قضايا التمييز العنصري وطبيعتها ومقاضاة مرتكبيها وإدانتهم والعقوبات المنزلة بحقهم.
