2. Each State Party shall consider providing for the possibility, in appropriate cases, of mitigating punishment of an accused person who provides substantial cooperation in the investigation or prosecution of an offence established in accordance with this Convention.
2- تنظر كل دولة طرف في أن تتيح، في الحالات المناسبة، إمكانية تخفيف عقوبة المتهم الذي يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة بشأن فعل مجرّم وفقا لهذه الاتفاقية.

3. Each State Party shall consider providing for the possibility, in accordance with fundamental principles of its domestic law, of granting immunity from prosecution to a person who provides substantial cooperation in the investigation or prosecution of an offence established in accordance with this Convention.
3- تنظر كل دولة طرف في إمكانية منح الحصانة من الملاحقة القضائية، وفقا للمبادئ الأساسية لقانونها الداخلي، لأي شخص يقدم عونا كبيرا في عمليات التحقيق أو الملاحقة بشأن فعل مجرّم وفقا لهذه الاتفاقية.

(a) Immunity from prosecution may be granted to a person who provides substantial cooperation with law enforcement authorities in the investigation and prosecution of an offence established in article(s) ___ [alternatively: of an offence covered by this Convention]; or
)أ( اما منح الحصانة من المحاكمة لشخص يقدم معاونة مهمة لسلطات انفاذ القوانين في التحقيق والملاحقة القضائية بشأن جرم منصوص عليه في المادة )المواد( - ]أو بدلا من ذلك : بشأن جرم تشمله هذه الاتفاقية[ ؛ أو

1. States Parties shall promote appropriate methods of obtaining information and testimony from persons who are willing to cooperate in the investigation and prosecution of an offence established in article(s) ___ [alternatively: of an offence covered by this Convention] and shall, as appropriate, assist each other in promoting such cooperation.
١ - تشجع الدول اﻷطراف اتباع طرائق مناسبة في الحصول على المعلومات والشهادات من اﻷشخاص الراغبين في التعاون في التحقيق والملاحقة القضائية بشأن جريمة منصوص عليها في المادة )المواد( - ]وبدلا من ذلك : بشأن جريمة تشملها هذه الاتفاقية[ ، وتساعد بعضها بعضا ، حسب الاقتضاء ، في تعزيز هذا التعاون .

(g) To provide protection for persons who have given or agreed to give information or evidence, or who participate or who have agreed to participate in an investigation or prosecution of an offence established in accordance with this Convention, and for the relatives and associates of such persons who require protection because of risks to the security of the person.
)ز( لتوفير الحماية لﻷشخاص الذين قدموا معلومات أو أدلة أو وافقوا على تقديمها، أو الذين يشاركون، أو وافقوا على المشاركة، في تحقيق أو مقاضاة قانونية تتعلق بجرم مقرر وفقا لهذه الاتفاقية، وكذلك ﻷقارب وذوي أولئك اﻷشخاص الذين يحتاجون إلى حماية بسبب وجود مخاطر تتهدد أمنهم الشخصي.

(b) Organizing, directing, aiding, abetting, facilitating or counselling the commission of an offence established in accordance with paragraph 1 of this article.
(ب) تنظيم ارتكاب جرم من الجرائم المقررة وفقا للفقرة 1 من هذه المادة، أو توجيهه أو المساعدة أو التحريض عليه أو تسهيله أو إسداء المشورة بشأنه.

1. Each State Party shall make the commission of an offence established in accordance with this Convention liable to sanctions that take into account the gravity of that offence.
1- تقضي كل دولة طرف بإخضاع ارتكاب أي فعل مجرم وفقا لهذه الاتفاقية لجزاءات تراعى فيها خطورة ذلك الجرم.

States Parties shall give consideration to the possibility of transferring to one another proceedings for criminal prosecution of an offence established in article(s) ___ [alternatively: of an offence covered by this Convention] in cases where such transfer is considered to be in the interests of the proper administration of justice, in particular in cases where more jurisdictions are involved, with a view to concentrating the prosecution.
تنظر الدول اﻷطراف في امكانية أن تنقل من احداها الى اﻷخرى دعاوى الملاحقة الجنائية للجرائم المبينة في المادة )المواد( _____ ]أو بدلا من ذلك : الجرائم التي تتناولها هذه الاتفاقية[ في الحالات التي يعتبر فيها ذلك النقل في صالح اقامة العدالة على نحو سليم ، وخصوصا في الحالات التي تمس أكثر من ولاية قضائية واحدة ، وذلك بهدف تركيز الملاحقة .

States Parties shall give consideration to the possibility of transferring to one another proceedings for criminal prosecution of an offence established in article(s) [...] [alternatively: of an offence covered by this Convention] in cases where such transfer is considered to be in the interests of the proper administration of justice, in particular in cases where more jurisdictions are involved, with a view to concentrating the prosecution.
على الدول اﻷطراف أن تنظر في امكانية أن تنقل احداها الى اﻷخرى اجراءات الملاحقة الجنائية للجرائم المقررة في المادة )المواد( ]...[ ]أو بدلا من ذلك : الجرائم المشمولة بهذه الاتفاقية[ في الحالات التي يعتبر فيها ذلك النقل في صالح التسيير السليم لشؤون العدالة ، وخصوصا عندما يتعلق اﻷمر بأكثر من ولاية قضائية واحدة ، وذلك بهدف تركيز الملاحقة .

2. Each State Party shall consider encouraging its nationals and other persons with a habitual residence in its territory to report to the national investigating and prosecuting authorities the commission of an offence established in accordance with this Convention.
2- تنظر كل دولة طرف، في تشجيع رعاياها وغيرهم من الأشخاص الذين يوجد مكان إقامتهم المعتاد في اقليمها على إبلاغ السلطات الوطنية المعنية بالتحقيق والملاحقة عن ارتكاب فعل مجرّم وفقا لهذه الاتفاقية.

2. Each State Party shall consider encouraging its nationals and other persons with a habitual residence in its territory to report to the national investigating and prosecuting authorities the commission of an offence established in accordance with this Convention.
2- تنظر كل دولة طرف، في تشجيع رعاياها وغيرهم من الأشخاص الذين يوجد مكان إقامتهم المعتاد في إقليمها على إبلاغ السلطات الوطنية المعنية بالتحقيق والملاحقة عن ارتكاب فعل مجرّم وفقا لهذه الاتفاقية.

1. Each State Party shall take appropriate measures to encourage persons who participate or who have participated in the commission of an offence established by this Convention to supply information useful to competent authorities for investigative and evidentiary purposes and to provide factual, specific help to competent authorities that may contribute to the recovery of proceeds of crime.
1- تتخذ كل دولة طرف تدابير مناسبة لتشجيع الأشخاص الذين يشاركون أو شاركوا في ارتكاب فعل مجرّم وفقا لهذه الاتفاقية على تقديم معلومات مفيدة إلى السلطات المختصة لأغراض التحقيق والاثبات، وعلى توفير مساعدة فعلية محددة للسلطات المختصة يمكن أن تسهم في استرداد العائدات الإجرامية.

(h) " Proceeds of crime " shall mean any property derived from or obtained, directly or indirectly, through the commission of an offence established in accordance with this Convention;
(ح) يقصد بتعبير " عائدات اجرامية " أي ممتلكات تتأتى أو يتحصل عليها، بشكل مباشر أو غير مباشر، من ارتكاب فعل مجرّم وفقا لهذه الاتفاقية؛

(b) Substantial cooperation provided by an accused person in the investigation and prosecution of an offence established in article(s) ___ [alternatively: of an offence covered by this Convention] may be considered a mitigating factor in determining the person’s punishment.
)ب( اعتبار المعونة المهمة التي يقدمها شخص متهم في التحقيق والملاحقة القضائية بشأن جرم منصوص عليه في المادة )المواد( ـــ ]أو بدلا من ذلك : بشأن جرم تشمله هذه الاتفاقية[ عاملا مخففا في تحديد عقوبة ذلك الشخص .

(a) Granting immunity from prosecution to a person who cooperates substantially with law enforcement authorities in the investigation and prosecution of an offence established in article(s) [...] [alternatively: of an offence covered by this Convention]; Several delegations noted that their legal system did not allow for the possibility of granting immunity, and some called for the deletion of this subparagraph.
)أ( منح الحصانة من المحاكمة لشخص يقدم معاونة مهمة لسلطات انفاذ القوانين في التحقيق والملاحقة القضائية بشأن جرم منصوص عليه في المادة )المواد( ]...[ ]أو بدلا من ذلك : بشأن جرم تشمله هذه الاتفاقية[ ؛لاحظت عدة وفود أن نظمها القانونية لا تتيح امكانية منع الحصانة ، ودعا بعضها الى حذف هذه الفقرة الفرعية .

في الحصول على المعلومات والشهادات من اﻷشخاص الراغبين في التعاون في التحقيق والملاحقة القضائية بشأن جريمة منصوص عليها في المادة )المواد( - ]وبدلا من ذلك : بشأن جريمة تشملها هذه الاتفاقية[ ، وأن تساعد بعضها بعضا ، حسب الاقتضاء ، في تعزيز هذا التعاون .

1 - تقضي كل دولة طرف بإخضاع ارتكاب أي فعل مجرم وفقا للمواد 5 و6 و8 و23 من هذه الاتفاقية لجزاءات تراعى فيها خطورة ذلك الجرم.
