The principle that every person who prior to the succession of States had the nationality of the predecessor State has the right to the nationality of at least one of the States involved in such succession is a sound basis on which the draft as a whole is built.

They were pleased to note that the Commission had not only reinforced the right to a nationality, but had also given it a precise scope and applicability by declaring, in article 1, that every individual who, on the date of the succession of States, had had the nationality of the predecessor State had the right to the nationality of at least one of the States concerned.

If a child born after the date of the succession of States whose parent is a person mentioned in paragraph 1 of this article has not acquired the nationality of at least one of the States concerned, or that of a third State, such child has the right to acquire the nationality of the State concerned on whose territory or otherwise under whose jurisdiction (hereafter " on the territory " ) he or she was born.
