Article 40 thereof presents another line of attack against bank secrecy, providing that " (e)ach State party shall ensure that, in the case of domestic criminal investigations of offences established in accordance with this Convention, there are appropriate mechanisms available within its domestic legal system to overcome obstacles that may arise out of the application of bank secrecy laws " .

30. The most significant change in 2005 OECD article 26 is the addition of article 26 (5), which provides generally for an override of bank secrecy laws as follows:
