١١ - وفي ضوء ما تقدم، ترى اللجنة أن الدولة الطرف ملزمة، في الظروف الراهنة، بالامتناع عن إعادة السيد كافح ياراغ طالا بالقوة إلى إيران، أو إلى أي بلد آخر يواجه فيه خطرا حقيقيا بطرده أو إعادته إلى إيران.

In the light of the above, the Committee is of the view that, in the prevailing circumstances, the State party has an obligation to refrain from forcibly returning Mr. Ali Falakaflaki to the Islamic Republic of Iran, or to any other country where he runs a real risk of being expelled or returned to Iran.
٧ - وفي ضوء ما تقدم، ترى اللجنة أن الدولة الطرف ملزمة، في الظروف الراهنة، بالامتناع عن إعادة السيد علي فلكفلاكي بالقوة إلى جمهورية إيران اﻹسلامية، أو إلى أي بلد آخر يواجه فيه خطرا حقيقيا بطرده أو إعادته إلى إيران.
