In this regard, the Committee wishes to reiterate its previously stated position, that under no circumstances must diplomatic guarantees be used as a safeguard against torture or ill-treatment where there are substantial grounds for believing that a person would be in danger of being subjected to torture or ill-treatment upon return (art. 3).

11.3 The Committee has to assess whether in the present case, the author's asylum request asserting that he was at risk upon return to Armenia was adequately evaluated by the State party authorities and whether he would indeed face a real risk of being subjected to torture or ill-treatment upon return to his country of origin.
11-3 وعلى اللجنة أن تقيّم ما إذا كانت سلطات الدولة الطرف قد قيّمت التماس لجوء صاحب البلاغ الذي يؤكد، في هذه القضية، أنه كان معرضاً للخطر عند عودته إلى أرمينيا، تقييماً مناسباً أم لا، وما إذا كان يواجه بالفعل خطراً حقيقاً بالتعرض للتعذيب أو سوء المعاملة لدى عودته إلى بلده الأصلي.
