A unilateral statement made by a State or an international organization when that State or organization expresses its consent to be bound by a treaty, in accordance with a clause expressly authorizing the parties or some of them to exclude or to modify the legal effect of certain provisions of the treaty in their application to those parties, constitutes a reservation.
يشكل تحفظاً الإعلان الانفرادي الذي تصدره دولة أو منظمة دولية عند إعراب تلك الدولة أو المنظمة عن موافقتها على الالتزام بمعاهدة، وفقاً لشرط صريح يرخص للأطراف أو لبعضها استبعاد أو تعديل الأثر القانوني لأحكام معينة من المعاهدة من حيث انطباقها على هذه الأطراف.

The substantive element of the definition was teleological in nature, since a reservation purported to exclude or modify the legal effect of certain provisions of the treaty in their application to the State or international organization concerned.
وإن العنصر الموضوعي للتعريف قصدي بطبيعته، ﻷن التحفظ هو بقصد استبعاد أو تعديل اﻷثر القانوني ﻷحكام معينة من المعاهدة في تطبيقها على دولة أو منظمة دولية معنية.

فإذا كان هذا اﻹعلان يهدف مع ذلك إلى استبعاد أو تعديل اﻷثر القانوني لبعض أحكام المعاهدة في تطبيقها على مقدمه، فيجب اعتباره بمثابة تحفظ غير مقبول " .

3. “... whereby the State or organization purports to exclude or to modify the legal effect of certain provisions of the treaty in their application to that State or to that organization”
وتهدف تلك الدولة أو تلك المنظمة من اﻹعلان إلى استبعاد أو تعديل اﻷثر القانوني ﻷحكام معينة من المعاهدة في تطبيق هذه اﻷحكام على هذه الدولة أو هذه المنظمة "

A unilateral statement which is made by a State at the time of the notification of the territorial application of a treaty and by which that State purports to exclude or to modify the legal effect of certain provisions of the treaty in their application to the territory in question constitutes a reservation.
اﻹعلان الانفرادي الذي تصدره دولة بمناسبة إشعار بالتطبيق اﻹقليمي لمعاهدة، والذي تستهدف منه استبعاد أو تعديل اﻷثر القانوني ﻷحكام معينة من المعاهدة في تطبيقها على اﻹقليم المعني، يشكل تحفظا.

Article 2, paragraph 1 (d), of the Vienna Convention on the Law of Treaties of 23 May 1969 states that a reservation " purports to exclude or to modify the legal effect of certain provisions of the treaty in their application to that State " , without providing further details on the modification effected by the reservation.
فالفقرة 1 (د) من المادة 2 من اتفاقية فيينا لقانون المعاهدات، المؤرخة 23 أيار/مايو 1969، تنص على أن التحفظ " [يستهدف] استبعاد أو تغيير الأثر القانوني لأحكام معينة في المعاهدة في تطبيقها على تلك الدولة " ، دون إعطاء تفاصيل أدق بشأن التعديل الذي يجريه التحفظ.

On the one hand, the character of both is imparted by the objective pursued by the author: excluding or modifying the legal effect of certain provisions of the treaty in their application to its author in the first instance, and specifying or clarifying the meaning attributed by the declarant to the treaty or to certain of its provisions, in the second instance;

It is clear from article 2, paragraph 1 (d), of the Vienna Conventions, from which the text in guideline 1.1 of the Guide to Practice is taken, that the object of reservations is to exclude or to modify " the legal effect of certain provisions of the treaty in their application " to their authors.
