13. The exploitative use of children in prostitution and pornography was to some extent already covered by article 34 of the Convention, which asks States parties to take all appropriate measures to prevent these unlawful activities.

The representative of Colombia drew the attention of participants to an issue raised by the representative of Peru regarding the fact that in defining child prostitution and penalizing it, they were in fact penalizing pimping and defining the involvement of children in prostitution.
45- استرعى ممثل كولومبيا انتباه المشتركين إلى مسألة أثارها ممثل بيرو مفادها أن المشاركين يجرمون في الواقع القوادة ويعرفون إشراك الأطفال في البغاء لدى تعريفهم لاستغلال الأطفال في البغاء وتجريمه.

66. The Penal Code criminalizes the authors and the accomplices of those who sell and traffic children, and who induce or facilitate the involvement of children in prostitution and pornography.
66- يجرِّم قانون العقوبات كل من يخطط لبيع أطفال والاتجار بهم وكل من يتواطأ في ذلك، كما يجرِّم كل من يحرّض على استخدام الأطفال في البغاء وفي المواد الخليعة أو ييسِّر ذلك.

75. The United Kingdom is carrying out a review of legislation concerning sexual offences with specific proposals to tackle the involvement of children in prostitution and pornography.
75- تجري المملكة المتحدة استعراضاً للتشريعات المتعلقة بالجرائم الجنسية مع مقترحات محددة للتصدي لاستخدام الأطفال في البغاء وفي المواد الخليعة.

The Government had also supported the European Union Framework Decision on combating sexual exploitation of children and child pornography, aimed at harmonizing criminal law and sanctions on the protection, distribution and possession of child pornography and engaging in sexual activities with a child, as well as the involvement of children in prostitution.

131. The Committee recommends that further measures, including legal reform, be taken to fully implement the provisions of article 34 of the Convention, to prevent and combat sexual economic exploitation of children, including the use of children in prostitution and pornography and the trafficking and abduction of children.

States parties shall in particular take all appropriate measures to prevent the exploitative use of children in prostitution or other unlawful sexual practices, and ensure that no child is subjected to torture or other cruel, inhuman or degrading treatment or punishment (art. 37).

46. More specifically, under articles 19 and 34, States parties undertake to protect the child from all forms of sexual exploitation and sexual abuse, taking all appropriate measures to prevent the inducement of children to engage in any unlawful sexual activity, the exploitative use of children in prostitution or other unlawful sexual practices and the exploitative use of children in pornographic performances and materials.

Under the Convention, States parties also undertake to protect the child from all forms of sexual exploitation and sexual abuse and are required to take measures to prevent the inducement or coercion of a child to engage in any unlawful sexual activity; the exploitative use of children in prostitution or other unlawful sexual practices and the exploitative use of children in pornographic performances and materials.
٢٣- وتتعهد الدول اﻷطراف، بمقتضى الاتفاقية، بحماية الطفل من كل أشكال الاستغلال الجنسي والانتهاك الجنسي وتكون مطالبة باتخاذ التدابير اللازمة لمنع تحريض الطفل أو اكراهه على ممارسة أي نشاط جنسي غير مشروع؛ والاستخدام الاستغلالي لﻷطفال في الدعارة أو غيرها من الممارسات الجنسية غير المشروعة، والاستخدام الاستغلالي لﻷطفال في العروض والمواد الداعرة.

58. Expresses deep concern about the persistence of the practices of the sale of children, child slavery and sexual exploitation of children in prostitution and pornography, and calls upon all States:

The report outlines the procedure which the Special Rapporteur will adopt to investigate information he receives, particularly with respect to individual complaints alleging situations of sale of children and involvement of children in prostitution or pornography.
