20. Certain general principles underline the obligation of States to protect the rights of all children, and are of relevance to the situation of children in the context of migration.

The Special Rapporteur on the human rights of migrants focused on the protection of children in the context of migration during 2009 and is currently investigating the rights of migrants in relation to health and housing.

On 28 September 2012, the Special Rapporteur participated in the Committee on the Rights of the Child day of general discussion on the rights of children in the context of migration.

21. The Special Rapporteur submitted a thematic report to the Human Rights Council on the protection of children in the context of migration (see A/HRC/11/7), and wishes to draw the attention of the General Assembly to some of the issues that he deems to be worthy of special attention.

Also relevant to the situation of children in the context of migration are the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, and the Protocol against the Smuggling of Migrants by Land, Sea and Air, supplementing the United Nations Convention against Transnational Organized Crime.

71. The Inter-American Court of Human Rights has asserted that access to education is one of the special protection measures with which State parties are obliged to comply, also in the case of children in the context of migration.
71- وأكدت محكمة البلدان الأمريكية لحقوق الإنسان أن الوصول إلى التعليم أحد تدابير الحماية الخاصة التي تُلزم الدول الأطراف على الامتثال لها، كذلك في حالة الأطفال في سياق الهجرة().

27. In the light of the above, the Special Rapporteur deems it important that a discussion on the protection of children in the context of migration be held.
