B. Punitive criminal justice policies and the overuse of detention and imprisonment
باء- سياسات العدالة الجنائية العقابية والفرط في استخدام الاحتجاز والسجن

A cross-cutting underlying cause for the overuse of detention and imprisonment is detainees' lack of access to legal counsel, which affects in particular the poor and vulnerable.
52- ومن الأسباب الشاملة التي تكمن وراء الإفراط في استخدام الاحتجاز والسجن عجز المحتجزين عن الاستعانة بالمحامين، وهي مشكلة تؤثر بوجه خاص على الفقراء والضعفاء.

The Committee believes that measures are needed to guarantee respect for such principles as the right of such minors to receive treatment that promotes their reintegration into society, the use of detention and imprisonment only as a last resort, the right of minors to be heard in criminal proceedings relating to them and the right to receive appropriate legal assistance.

Action plans on crime prevention should aim at preventing child and youth involvement in crime; reducing the use and duration of detention and imprisonment for youth, especially at the pretrial stage; fostering diversion of young offenders from the criminal justice system; and promoting the use of restorative justice processes and alternatives to detention.
وقيل إنه ينبغي لخطط العمل بشأن منع الجريمة أن ترمي إلى منع تورّط الأطفال والشباب في الجريمة؛ وتقليل الاستعانة بالاحتجاز والسجن ومدة ذلك الاحتجاز والسجن بالنسبة إلى الشباب، بالأخص في المرحلة السابقة للمحاكمة؛ وتشجيع تحويل الشباب الجانحين من مسار نظام العدالة الجنائية؛ والترويج لاستخدام إجراءات العدالة التصالحية وبدائل الاحتجاز.

(e) Ensuring that the Body of Principles for the Protection of All Persons under Any Form of detention and imprisonment are applied to all migrants under administrative detention.
(ﻫ) ضمان تطبيق مجموعة المبادئ المتعلقة بحماية جميع الأشخاص الذين يتعرضون لأي شكل من أشكال الاحتجاز أو السجن على جميع المهاجرين رهن الاحتجاز.

The Committee recommends that the State party abolish the special isolation regime and ensure that all prisoners are treated humanely and in accordance with the Standard Minimum Rules for the Treatment of Prisoners (approved by the Economic and Social Council in its resolutions 663 C (XXIV) of 31 July 1957 and 2076 (LXII) of 13 May 1977) and the Body of Principles for the Protection of All Persons under Any Form of detention and imprisonment.
