Conditions of detention for children in conflict with the law, including in police stations while under arrest and in detention centres, are often poor and inadequate, in some cases amounting to cruel, inhuman or degrading treatment.

This should be undertaken for all professional groups working for and with children, such as judges, lawyers, law enforcement officials, armed and security forces, journalists, civil servants, personnel working in institutions and places of detention for children, teachers, health-care personnel, including psychologists, and social workers.

19. In 2001, CRC expressed concern at the extremely poor conditions of detention for children, amounting in many instances to cruel, inhuman and degrading treatment as spelled out in article 37 (a) of the Convention.
19- وفي عام 2001، أعربت لجنة حقوق الطفل عن قلقها إزاء ظروف احتجاز الأطفال البالغة السوء التي تعتبر في حالات كثيرة بمثابة معاملة قاسية أو لا إنسانية أو مهينة على النحو الموضح في المادة 37(أ) من الاتفاقية(64).

States parties are encouraged to undertake systematic child rights training for children and their parents, as well as for all professionals working for and with children, in particular parliamentarians, judges, magistrates, lawyers, lawenforcement officials, civil servants, personnel in institutions and places of detention for children, teachers, health personnel, social workers and local leaders.

Ill-treatment 317. While welcoming the inclusion of a provision in the new Constitution prohibiting torture or other cruel, inhuman or degrading treatment and punishment, the Committee is concerned at the extremely poor conditions of detention for children, amounting in many instances to cruel, inhuman and degrading treatment as spelled out in article 37 (a) of the Convention.
317- ترحب اللجنة بإدراج حكم في الدستور الجديد يحظر التعذيب أو غيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، إلا أن القلق يساورها إزاء ظروف احتجاز الأطفال البالغة السوء التي تعتبر في حالات كثيرة بمثابة معاملة قاسية أو لا إنسانية أو مهينة على النحو الموضح في المادة 37(أ) من الاتفاقية.

(b) Develop systematic and ongoing training programmes on human rights, including children's rights, for all professional groups working for and with children (e.g. judges, lawyers, law enforcement officials, civil servants, local government officials, personnel working in institutions and places of detention for children, teachers and health personnel); and
(ب) إعداد برامج منتظمة ومستمرة للتدريب على حقوق الإنسان، بما في ذلك حقوق الطفل، لكل المجموعات المهنية التي تعمل من أجل الأطفال ومعهم (ومنها على سبيل المثال القضاة والمحامون والمسؤولون عن تنفيذ القانون والموظفون الحكوميون وموظفو الحكم المحلي والعاملون في مؤسسات وأماكن احتجاز الأطفال والمدرسون والعاملون في مجال الصحة)؛

The Committee encourages the State party to continue with its efforts in the provision of sensitization programmes and training to all professional groups working with and for children, such as judges, lawyers, law enforcement and army officials, civil servants, personnel working in institutions and places of detention for children, teachers and health personnel, including psychologists and social workers.
وتشجع اللجنة الدولة الطرف على مواصلة جهودها في تنفيذ برامج التوعية وفي تدريب جميع فئات الفنيين العاملين في أوساط الأطفال ومن أجلهم، مثل القضاة والمحامين وموظفي إنفاذ القانون وضباط الجيش وموظفي الخدمة المدنية والموظفين الذين يعملون في مؤسسات رعاية الأطفال وفي الأماكن التي يحتجز فيها الأطفال والمعلمين وموظفي الصحة بمن فيهم أخصائيو علم النفس والعاملون الاجتماعيون.

It recommended that Maldives: expedite efforts to draft and enact a Juvenile Justice Act in compliance with the Convention; raise the minimum age of criminal responsibility to at least 12 years; establish specialized juvenile courts; provide children in conflict with the law with access to education and; improve the condition of detention for children.
وأوصت اللجنة ملديف بالقيام بما يلي: تسريع الجهود الرامية إلى صياغة وسن قانون لقضاء الأحداث امتثالاً للاتفاقية؛ ورفع السن الأدنى للمسؤولية الجنائية إلى ما لا يقل عن 12 عاماً؛ وإنشاء محاكم متخصصة للأحداث؛ وتزويد الأطفال المخالفين للقانون بإمكانية الحصول على التعليم؛ وتحسين ظروف الاحتجاز للأطفال(82).
